[HISTORY: Adopted by the Common Council of the City of St. Francis as §§ 12.23 and 12.25 of the 1981 Code. Amendments noted where applicable.]
As used in this chapter, the following terms shall have the meanings indicated:
PARADE
A procession of any kind or any similar display in or upon any street, sidewalk or right-of-way in the City of St. Francis that tends to disrupt or interfere with the normal flow of vehicular or pedestrian traffic on any street, sidewalk or other public place.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
RUN
Any type of event, whether competitive or not, where a group of people is moving, whether aided by a bicycle or motor vehicle or not.
No person shall engage in, participate in, aid, form or start any parade or run unless a permit therefor has been obtained from the City of St. Francis.
This chapter shall not apply to the following, except that their parade date, route, and parade chairman must be approved by the Common Council:
A. 
Fourth of July parade.
B. 
St. Francis Day Parade and all other City-sponsored parades.
C. 
Homecoming parade of any high school located in the City of St. Francis.
D. 
Funeral processions, which are also not required to have the parade date and route approved by the Common Council.
A. 
A person seeking issuance of a permit shall file a written application with the City Clerk, who shall then forward such to the Common Council.
B. 
Filing date. The written application for a permit shall be filed with the City Clerk not less than 30 days before the date on which it is proposed to conduct the parade.
C. 
Contents. The application for a permit shall set forth the following information:
(1) 
The true and correct name, address, and telephone number of the person seeking to conduct the parade or run.
(2) 
If the parade or run is proposed to be conducted for, on behalf of, or by an organization, the true and correct name, address, and telephone number of the headquarters of the organization and of the authorized and responsible heads of such organization.
(3) 
The true and correct name, address and telephone number of the person who will be the parade or run chairman and of all persons who will be in charge of and responsible for its conduct.
(4) 
The date when the parade or run is to be conducted.
(5) 
The route to be traveled, the starting point, and the termination point.
(6) 
The approximate number of person who, animals and vehicles which, and signs, banners, and flags which will be in the parade or run, the type of animals, and a description of the vehicles and the signs, banners, and flags.
(7) 
The hours when the parade or run will start and terminate.
(8) 
A statement as to whether the parade or run will occupy all or only a portion of the width of the street proposed to be traversed.
(9) 
The location by streets of any assembly areas for the parade or run.
(10) 
The time at which units of the parade or run will begin to assemble at any such assembly area or areas.
(11) 
The interval of space to be maintained between units of the parade or run.
(12) 
If the parade or run is designed to be held by and on behalf of or for any person other than the applicant, the applicant for such permit shall file with the City Clerk a communication in writing for the person proposing to hold the parade or run authorizing the applicant to apply for the permit on his behalf.
(13) 
Any additional information which the City Clerk or, in his absence, his designee shall find reasonably necessary to a fair determination as to whether a permit shall be issued.
D. 
Fee. There shall be paid at the time of filing the application for a permit a fee as provided by the current fee schedule on file with the City Clerk. The Common Council shall have authority to refund the fee for a permit applied for by a school or religious congregation. A deposit of $75 shall also be tendered with the application. Such deposit shall be used to ensure compliance with this chapter. Any moneys not used from such deposit shall be refunded to the applicant.
A. 
The Common Council shall issue a permit as provided for hereunder when, from a consideration of the application and from such other information as may otherwise be obtained, including recommendations of the Fire Chief and Police Chief, it finds that:
(1) 
The conduct of the parade or run will not substantially interrupt the safe and orderly movement of other traffic contiguous to its route.
(2) 
The conduct of the parade or run will not require the diversion of so great a number of police officers of the City to properly police the line of movement and the areas contiguous thereto as to prevent normal police protection to the City.
(3) 
The concentration of persons, animals, and vehicles at assembly points of the parade will not unduly interfere with proper fire and police protection of, or ambulance service to, areas contiguous to such assembly area.
(4) 
The conduct of such parade or run will not interfere with the movement of fire-fighting equipment en route to a fire or with fire rescue equipment.
(5) 
The conduct of the parade or run is not reasonably likely to cause injury to persons or property, to provoke disorderly conduct or create disturbances or incite a riot.
(6) 
The parade or run is scheduled to move from its point of origin to its point of termination expeditiously and without unreasonable delays en route.
(7) 
The parade or run is not to be held for the sole purpose of advertising any product, goods or event and is not designed to be held purely for private profit.
(8) 
No other permit has been issued for conducting any other parade or run at the same time within the City.
B. 
The Common Council shall also consider the past performance of the permittee and/or the permittee's organization.[1]

C. 
If the reasons for permit denial can be compensated for (such as police overtime), the permit may be issued upon the payment of a fee anticipated to cover such expenses.
Immediately upon the issuance of a permit, the City Clerk shall send a copy thereof to the following:
A. 
The Police Chief.
B. 
The Fire Chief.
C. 
The City Engineer.
Each permit shall contain the following information:
A. 
Starting time.
B. 
Minimum speed.
C. 
Maximum speed.
D. 
The portions of the streets that may be used.
E. 
The route.
F. 
Terminating time.
G. 
The date of the event.
H. 
Any other information the Common Council deems appropriate.
A permittee hereunder shall comply with all permit directions and conditions and with all applicable laws and ordinances of the State of Wisconsin and the City of St. Francis. A permittee shall also be responsible for gathering and removing all litter and refuse resulting from the parade or run and discarded along the route of such event. The person in charge of such activity shall carry the permit on his person during the conduct of the event.
No person shall unreasonably hamper, obstruct or impede or interfere with any parade, parade assembly or run, or with any person, vehicle or animal participating or used in the event, nor shall any other organization or group of persons not included in the application for permit participate in the event.
No driver of a vehicle shall drive between the vehicles or persons comprising a parade or run when such vehicles or person are in motion. However, the parade or run shall permit passage of authorized emergency vehicles.
Where the City of St. Francis must use any of its equipment, personnel or otherwise above and beyond normal maintenance as a result of the event to which the above permit is issued, the cost thereof shall be charged to the person or organization to whom or to which the permit is issued, if no arrangements have been made for beforehand under § 329-5C above.
In addition to the suspension or revocation of a license issued under this chapter, any person who shall violate any provision of this chapter or any regulation, rule or order made hereunder shall be subject to a penalty as provided by § 1-4 of this Code.
