A. 
No person shall, in any manner, obstruct a public sidewalk, plaza or stairway or any portion thereof so as to create a condition that would interfere with, impede or prevent free passage thereon.
B. 
No person shall, in any manner, obstruct a public way, parking area or parking garage or any portion thereof so as to create a condition that would interfere with, impede or prevent free passage or parking thereon or therein.
C. 
The prohibitions of Subsections A and B of this section shall not apply to:
(1) 
Work being performed on, in or adjacent to a public way, sidewalk, plaza, stairway, parking area or parking garage, which is being performed pursuant to a permit or permits issued under the provisions of the City Code and/or the Rules and Regulations of the Traffic Commission, provided that such work is conducted in strict conformity with any conditions contained in the permit or permits;
(2) 
Work being performed on, in or adjacent to a public way, sidewalk, plaza, stairway, parking area or parking garage, if such work is being performed by a department of the City of Marlborough or the Commonwealth of Massachusetts;
(3) 
Emergency work being performed by a public utility on, in or adjacent to a public way, sidewalk, plaza, stairway, parking area or parking garage, if such work is necessary to protect life or prevent damage to property;
(4) 
Any activity, assembly, event or parade organized or sponsored by the City of Marlborough;
(5) 
Any activity, assembly, event or parade that is being conducted pursuant to a permit or permits issued under the provisions of the City Code and/or the Rules and Regulations of the Traffic Commission, provided that such activity, assembly, event or parade is conducted in strict conformity with any conditions contained in the permit or permits; and
(6) 
The closure or obstruction of a public way, sidewalk, plaza, stairway, parking area or parking garage for a purpose relating to public safety.
D. 
No person shall throw any object in, into or across any public way, sidewalk, plaza, stairway, parking area or parking garage.
E. 
No person, other than a customer, occupant, owner or tenant, shall remain on the steps or within the doorway, portico or other projection of any building which abuts a public way or sidewalk without the express permission of the owner or person in control of the building.
F. 
No person shall, in any manner, enter the waters of Fort Meadow Reservoir from either the Bolton Street Causeway or the Reservoir Street Causeway.

Any person who remains in a public place while in wilful violation of any of the prohibitions of § 462-1 may be arrested, without a warrant, by a police officer acting pursuant to the provisions of MGL c. 272, § 59.
Any person found guilty of violating any of the prohibitions of § 462-1 shall be fined:
A. 
One hundred dollars for a first offense;
B. 
Two hundred dollars for a second offense; and
C. 
Three hundred dollars for a third or subsequent offense.
