Prior to the granting of final approval, the
subdivider shall have installed or shall have furnished adequate bond
for the ultimate installation of the improvements set out in this
article.
Capped monuments shall be placed at all block
corners, lot corners, angle points, points of curves in streets and
at intermediate points as shall be required by the Town Council.
All streets shall be paved in accordance with
applicable minimum construction standards of the Town. Such construction
shall be subject to inspection and approval by the Town Engineer or
some other person designated by the Town Council for that purpose.
The Town Council may, in its discretion, cause the subdivider to make
appropriate changes in street construction prior to approval of the
plat.
Curbs, gutters, drainage and drainage structures
shall be provided in accordance with applicable minimum construction
standards of the Town. Such construction shall be subject to the inspection
and approval of the Town Engineer or some other person designated
by the Town Council for that purpose. The Town Council may in its
discretion cause the subdivider to make appropriate changes in the
construction of curbs, gutters, drainage and drainage structures prior
to approval of the plat.
Sidewalks shall be constructed along at least
one side of every minor street shown on the plat in accordance with
applicable minimum construction standards of the Town, and sidewalks
shall be constructed along both sides of all arterial and collector
streets in accordance with applicable minimum construction standards
of the Town; provided, however, that where it is impracticable to
construct sidewalks, the Town Council may waive this requirement.
Sidewalk construction shall be subject to the inspection and approval
of the Engineer or some other person designated by the Town Council
for that purpose. The Town Council may in its discretion cause the
subdivider to make appropriate changes in sidewalk construction prior
to approval of the plat.
Street name signs shall be placed at all street
intersections within or abutting the subdivision. Such signs shall
be of a type approved by the Town and shall be placed in accordance
with the standards of the Town. Traffic-control devices, pedestrian-control
devices, signs, lights and flashing lights, which the Town in its
discretion deems necessary to carry out the provisions of state law
or Town ordinances or to regulate, warn or guide vehicular, bicycle
and pedestrian traffic, shall be installed in the subdivision at the
subdivider's expense and placed in accordance with the dictates and
requirements of the Town Council.
Streetlighting facilities and equipment must
be approved by the Town Engineer or some other person designated by
the Town Council for that purpose. The Town Council may in its discretion
cause the subdivider to make appropriate changes in streetlighting
facilities and equipment prior to approval of the plat.
Each lot within the subdivision area shall be
provided with a connection to the public water supply system. All
water systems, equipment and connections shall be subject to the inspection
and approval of the Town Engineer or some other person designated
by the Town Council for that purpose and shall be in accordance with
the minimum construction standards of the Town. The Town Council may,
in its discretion, cause the subdivider to make appropriate changes
in the construction of water systems, equipment and connections prior
to approval of the plat. No person other than the Town Water Commissioner
shall disturb, tamper with or make hookups or connections to Town
water lines.
Fire hydrants shall be installed in all subdivisions
in accordance with the applicable minimum construction standards of
the Town. Such construction shall be subject to the inspection and
approval of the Town Engineer or by some other person designated by
the Town Council for that purpose. The Town Council may in its discretion
cause the subdivider to make appropriate changes in such construction
prior to the approval of the plat.
Each lot within the subdivided area shall be
provided with a connection to the public sanitary sewer. Sanitary
sewer systems, equipment and connections shall be constructed and
installed in accordance with the Town minimum construction standards.
Such construction shall be subject to the approval of the Town Engineer
or some other person designated by the Town Council for that purpose.
The Town Council may, in its discretion, cause the subdivider to make
appropriate changes in the construction of sewer systems prior to
approval of the plat. No person other than the Town Water Commissioner
shall disturb, tamper with or make hookups or connections to Town
sewer lines.
In subdivisions beyond the Town limits where
a public water system is not reasonably accessible but where plans
for the installation of a public water system in the vicinity of a
subdivision have been prepared by the Town Engineer, the subdivider
may be required to install water systems in conformity with such plans.
In subdivisions beyond the Town limits where
a public water system does not extend to the boundary of the subdivision,
the Town Council may require, as a condition to the approval of the
plat, that the subdivider pay for all or part of the cost of constructing
and installing the necessary extensions, expansions and connections
of and to existing public water systems and lines to the boundary
of the subdivision. All such extensions, expansions and connections
shall be completed in accordance with the Town's minimum construction
standards, this chapter and such other specifications as the Town
Council shall in its discretion deem necessary.
All such construction shall be subject to the
inspection and approval of the Town Engineer or some other person
designated by the Town Council for that purpose. No person other than
the Town Water Commissioner shall disturb, tamper with or make hookups
or connections to existing Town water lines. The Town Council may
in its discretion cause the subdivider to make appropriate changes
in such construction prior to approval of the plat.
In subdivisions beyond the Town limits where
a public sanitary sewer system is not reasonably accessible but where
plans for the installation of sanitary sewers in the vicinity of a
subdivision have been prepared by the Town Engineer, the subdivider
may be required to install sewers in conformity with such plans.
In subdivisions beyond the Town limits where
a public sanitary sewer system does not extend to the boundary of

All such construction as is provided for in §§
400-95 and
400-96 shall be subject to the inspection and approval of the Town Engineer or some other person designated by the Town Council for that purpose. No person other than the Town Water Commissioner shall disturb, tamper with or make hookups or connections to existing Town sewer lines. The Town Council may in its discretion cause the subdivider to make appropriate changes in such construction prior to approval of the plat.
All trench excavation and backfill shall be
in accordance with the applicable minimum construction standards of
the Town.
All trench excavation and backfill shall be
subject to the inspection and approval of the Town Engineer or some
other person designated by the Town Council for that purpose. No person
shall commence any backfilling without first contacting the Town Engineer
or the person designated by the Town Council to inspect trench excavation
and backfill and without first receiving permission from the Town
representative to commence the specific backfilling requested.
If any person shall backfill in violation of §
400-99, the subdivider shall, upon the request of the Town Engineer or the person designated by the Town Council to inspect trench excavation and backfill, forthwith and at the subdivider's expense remove all such backfill to allow for all necessary inspections by the Town representative.
The Town Council may, in its discretion, cause
the subdivider to make appropriate changes in trench excavation and
backfill prior to approval of the plat.
All testing of materials and workmanship required
by this chapter, the Town minimum construction standards or by the
Town Engineer shall be performed by the subdivider and at the expense
of the subdivider. If the Town Engineer or a person designated by
the Town Council to inspect any phase of construction gives notice
to the subdivider that the Town representative desires to be present
to observe any testing, the subdivider shall not commence the testing
until the Town representative is present. If testing is commenced
without or prior to the attendance of the Town representative when
such notice has been given, the subdivider shall at the subdivider's
expense redo all such tests in the presence of the Town representative.
The Town Engineer or a person designated by the Town Council to inspect any phase of construction may require the subdivider to certify that each required test was performed and that the same was done in accordance with this chapter, the Town minimum construction standards and as specified by the Town Engineer. The certificate may be required either in lieu of or in addition to the attendance of a Town representative as provided in §
400-102.
If the Town Council is not satisfied with the
testing of materials and workmanship performed by the subdivider,
or if the Town Council believes that additional testing is necessary,
the Town Council may in its discretion cause the subdivider, at the
subdivider's expense, to redo tests or perform additional tests prior
to approval of the plat.
All of the Town minimum construction standards
then in effect shall be obligatory and applicable to subdivisions
whether or not any particular minimum construction standard is mentioned
in this chapter. This chapter is in addition to, and does not repeal,
Town ordinances relating to building permits and occupancy permits.

The Town shall assign an inspector to inspect
materials and workmanship at construction sites, on a part-time or
full-time basis, and the expense of such a Town inspector shall be
borne by the subdivider. Payment of the inspection fees shall be an
absolute condition precedent to approval of the subdivision.

A. Connections to the public water supply system, connections
to the public sanitary sewer system, and all trench excavation and
backfill, during frozen ground conditions, are prohibited. The Town
Engineer shall have the authority to determine that frozen ground
conditions exist. Once the Town Engineer has determined that frozen
ground conditions exist, notice of that fact shall be posted at the
Town Hall.
B. Frozen ground conditions shall, after the determination mentioned in Subsection
A of this section, be in effect until the Town Engineer determines that frozen ground conditions no longer exist and that fact is posted at the Town Hall. Nothing contained in this section shall prohibit emergency repairs to water or sewer lines made with the consent of the Town.
C. Any person making connections to the public water
supply system, connections to the public sanitary sewer system, or
performing any trench excavation or backfill, during frozen ground
conditions, is guilty of a misdemeanor and, upon conviction thereof,
shall be fined up to $200 or imprisoned in jail for up to 90 days.
In addition thereto, such violation shall be considered sufficient
grounds for the revocation of the applicable building permit, temporary
occupancy permit and/or occupancy permit.
