There shall be a Shade Tree Commission of the
Township of Bernards.

a. The Shade Tree Commission shall consist of seven regular
members and two alternate members, all of whom shall be residents
of the Township appointed by the Mayor, and they shall serve for staggered
five-year terms.
b. The term of each alternate member shall be five years
commencing on January 1 of the year of appointment; provided, however,
that the initial term of Alternate No. 2 shall be four years and the
initial term of Alternate No. 1 shall be five years. Alternate members
may participate in discussions of the proceedings but may not vote
except in the absence or disqualification of a regular member.

The Shade Tree Commission shall have the power
and authority for the regulation, planting, care and control of shade
and ornamental trees and shrubbery upon or in the highways, parks
or parkways within the jurisdiction of the Township of Bernards and
shall exercise all powers and rights and be subject to all duties
provided in Chapter 325 of the 1915 Laws of New Jersey (N.J.S.A. 40:64-1
et seq.), as amended and supplemented.

a. Public records. The records and minutes of the shade
tree commission shall be deemed public records.
b. Annual report. The Shade Tree Commission shall make,
keep and preserve minutes and records of its meetings and activities
and shall make an annual report to the Township Committee before the
15th day of January of the succeeding year.
c. Other reports. Within 10 days after each meeting of
the Shade Tree Commission, an exact copy of the minutes thereof shall
be filed with the Township clerk.

The Township Committee may appropriate funds
for the expenses incurred by the Shade Tree Commission. No expense
shall be incurred or contract entered into by the Commission unless
the funds therefor shall have been previously appropriated to the
purpose thereof by the Township Committee, and no obligation shall
be incurred for acquisition unless and until the Township Committee
shall approve and consent to the same and make the appropriation necessary
therefor.

The Commission may appoint such clerks and other
employees as it may from time to time require and as may be within
the limits of funds appropriated to it.
