All developments in non-woodland areas requiring approval of the Town Council shall be required to submit with their application and plans a tree preservation and planting plan as set forth in Article IV, and shall conform with the following provisions. The developer/property owner shall pay for the cost of all inspections related to tree planting requirements, including travel costs to locations outside the town limits of Dagsboro.
Existing trees may be preserved and new trees may be planted to achieve the minimum tree planting requirements of this chapter as specified below. For new tree plantings to be counted toward the tree planting requirement, new trees shall be of a species and minimum planting size as set forth in Appendix A (Table of Trees) of this chapter. Appendix A is included at the end of this chapter. All tree planting shall adhere to ANSI A300, Planting Standards.
For non-woodland portions of development tracts,
new trees shall be planted at a rate of one tree per 5,000 square
feet of lot area for residential land development and one tree per
3,000 square feet of site area for nonresidential land development.
Within woodland areas, no less than 75% of passive open space shall be planted, a rate of 50 trees per acre for residential land development. Open space plantings shall be of a species and minimum planting size as set forth in Appendix B (Table of Trees for Open Space).
A one-year full-price replacement guarantee
shall be provided by the applicant and noted on the record plan for
all required and new tree plantings. The developers shall provide
descriptions of the areas to be maintained by the developer, its assigns,
the homeowners' association or the condominium council, and the guarantee
required by this subsection in the restrictive covenant and/or the
Code of Regulations and Declaration Plan.
