The office of Borough Administrator is hereby created in and for the
Borough of Leonia, by and subject to the provisions of this chapter and in
accordance with state statute, and the employment of a person to fill such
office is hereby authorized.

A. Appointment of Borough Administrator. The Borough Administrator
shall be appointed by the Mayor with the advice and consent of the Borough
Council. In the event that the Mayor fails to nominate such Borough Administrator
within 30 days after the office is created or after the office should become
vacant or in the event that the Council fails to confirm any nomination made
by the Mayor, then, after the expiration of such 30 days, the Borough Council
shall appoint the Borough Administrator by a majority of at least three affirmative
votes, the Mayor having no vote thereon except in case of a tie.
B. Term. The term of office of the Borough Administrator
shall be at the pleasure of the governing body. He or she shall be removed
only by a two-thirds vote of the governing body.
C. Evaluation. On or before July 1 of each year, the Mayor
and Council shall conduct an evaluation of the Borough Administrator's performance
during the previous twelve-month period. Included among the criteria for such
evaluation shall be whether or not the Borough Administrator has substantially
accomplished his or her established goals and objectives. At the time of such
evaluation, the Mayor and Council shall establish goals and objectives to
be accomplished by the Borough Administrator during the next twelve-month
period.
D. Removal. The Borough Administrator shall be removed only
by a two-thirds vote of the governing body. Nothing in this subsection however,
shall be intended to constitute a contract of employment. The Borough Administrator's
employment shall be at the will of the Borough and his or her removal by the
Mayor and Council may be with or without cause.
The Borough Administrator shall receive such compensation as shall be
fixed, from time to time, by the Borough Council in a Salary Ordinance.

The Borough Administrator shall carry the responsibilities and perform
the duties which are herein described. The Administrator shall:
A. Serve as chief administrative officer of the Borough
and be responsible to the governing body for the proper and efficient administration
of the municipal services and business affairs of the Borough.
B. Act as Borough purchasing agent and shall be responsible
for undertaking or delegating the following:
(1) Establishing a central purchasing system, and monitoring
all Borough purchasing activities to assure that purchases are made in accordance
with statutory requirements; a current record of all budgeting accounts is
maintained; and funds for purchases are available in accordance with the budget.
(2) Providing a report of purchasing activities and statutes
when directed by the governing body.
(3) Issuing rules and regulations governing the requisition
and purchase of all municipal supplies and equipment as deemed necessary.
(4) Making, negotiating or awarding any purchases, contracts
or agreements for the purchase of such municipal supplies and equipment which
are not subject to public advertising for bids pursuant to the Local Public
Contracts Law, N.J.S.A. 40A:11-1 et seq., where such purchases do not exceed
in the fiscal year and total sum of $6,000. Where such purchases exceed the
total sum of $6,000 in the fiscal year, such purchases, contracts or agreements
shall be awarded by the governing body.
C. Serve as the personnel officer of the Borough and be
responsible for the appointment and removal of Borough personnel, except as
otherwise provided by law. The Administrator shall provide for a centralized
personnel system, including provision for the evaluation, promotion or disciplining
of all employees, and may authorize the head of a department to supervise
and control employees as appropriate according to the operation of the Borough.
The Administrator shall report at the next regular meeting of the governing
body any action taken pursuant to this section. The Administrator will represent
the governing body in negotiating collective bargaining agreements.
D. Serve as the budget officer, prepare and submit before
the close of the fiscal year, or at such time as the governing body shall
determine, a proposed budget for the next fiscal year and an explanatory budget
message. The Administrator shall be responsible for advising the governing
body as to timetable and schedule for budget processing so as to conform to
statutory requirements.
E. Execute and enforce the laws of the state and ordinances
and resolutions of the Borough as the governing body may prescribe.
F. Attend all meetings of the Borough governing body and
other committees as directed, with a right to take part in the discussion
and to receive notice of all regular and special meetings of the governing
body and all advisory committees.
G. Inform the governing body as to the conduct of Borough
affairs, submitting whatever report the governing body shall request and making
such recommendations to the governing body as he/she deems necessary and advisable
for the welfare of the Borough. In cooperation with the Treasurer, the Borough
Administrator shall see that the governing body is regularly informed about
the condition of the Borough finances. The Administrator shall anticipate
problems that may develop and advise the governing body accordingly, outlining
possible solutions or preventive measures.
H. Submit to the governing body, as soon as possible after
the close of the fiscal year, a complete written report of the administrative
activities of the Borough for the preceding year.
I. Recommend the employment of experts and consultants to
perform work and render advice in connection with the operation of dedicated
utilities or work projects in the Borough, subject to approval by the governing
body.
J. Attend to the letting of contracts, in due form of law,
and supervise the performance and faithful execution of these contracts, except
insofar as such duties are expressly imposed upon some other officer or official
by statute or by action of the governing body. He shall ensure compliance
with provisions of all franchises, leases, permits and privileges granted
by the Borough.
K. Study and keep the governing body informed as to federal,
state and/or county aid projects and any other services or possible grants
for which the Borough may qualify. The Borough Administrator shall coordinate
the application procedures and shall provide liaison for such aid, grants
or services which the Borough may acquire, subject to the direction of the
governing body.
L. Provide liaison with the Borough Attorney and any other
legal counsel engaged by the Borough and with other professional staff, as
the governing body may direct.
M. Maintain overall supervisory responsibility for areas described in §
4-5, which sets forth the duties of the Deputy Administrator.
N. Inform the governing body of any matter or transaction, or any contemplated matter or transaction, for which he or she is or would be responsible, but in which he or she has an interest as defined in Chapter
26 of the Code. In that event, the Administrator shall delegate the responsibility for such matter or transaction to another administrative officer of the Borough who has, or would have no such interest therein.

The Mayor may designate a qualified Assistant Administrator of the Borough,
subject to confirmation by a majority of the Borough Council. In the event
that the Mayor shall fail to make such designation, the Borough Council may,
by resolution, appoint a qualified Assistant Administrator to perform duties
herein described. The Assistant Administrator shall, subject to the direction
of the Administrator, carry the responsibilities and perform the duties which
are herein described. The Assistant Administrator shall:
A. Perform the duties which may be assigned to him/her by the governing
body.
B. Perform such duties which may be assigned to him/her by the Administrator.
The Borough Administrator and Assistant Administrator shall be appointed
on the basis of executive and administrative abilities, with special regard
to education, training and experience related to the functions assigned to
said offices in this chapter.
