No person or persons shall establish or maintain
any nursery school for the care and training of children of preschool
age without first having obtained a license therefor from the Board
covering all the premises intended to be so used. These premises must
conform to the Building and Zoning Ordinances and BOCA Codes of the
Borough.
Every application for a license shall be in
writing, and it shall contain a full description of the premises and
buildings intended to be used for such purpose and satisfactory proof
that every person employed thereat is free from communicable disease.
A copy of this application shall be submitted to the Fire Department
of the Borough.
Every license issued under this article shall
state the name or names of the licensee or licensees, the location
of the licensed premises and the maximum number of pupils to be cared
for at any one time.
No license for a nursery school or a day nursery
shall be issued until the Board has been notified, in writing, that
the State of New Jersey Department of Education and the New Jersey
State Department of Health have approved, in detail, the training
prescribed for said school.
A day nursery intended for the care of children
of preschool age shall be considered in the same category as a nursery
school and shall, therefore, be subject to the same regulations as
apply to a nursery school. In addition, a day nursery shall be considered
in the same category as a restaurant if food is being served and shall
be subject to the same regulations as apply to a restaurant; however,
payment of only one license fee would be required for such an establishment.
