This chapter shall be known as the "Address Display Law" of the Town of Chili.
It is essential that law enforcement, fire and ambulance personnel be able to locate homes, commercial properties and other buildings without delay to provide the most effective response to a call for service. The purpose of this chapter is to provide those emergency personnel in the Town of Chili with a means to quickly and accurately identify addresses when responding to such calls for assistance.
In all zoning districts established in Chapter 500, Zoning, of the Code of the Town of Chili, all principal buildings shall display at least one set of street numbers clearly indicating the address assigned to such buildings. In the case of new construction, no certificate of occupancy/certificate of compliance will be issued unless the owner and/or developer certifies to the Town that such street numbers have been installed.
Such numbers shall be Arabic in design with a minimum height of four inches and mounted in a secure fashion to the wall of the building or to a porch or other fixed appurtenance, easily visible from the main entryway or main path of travel leading to the main entrance from a public street or main parking lot. Numbers may also be mounted upon a post directly in the front of the premises in a manner which would provide a ready means of identifying the street number of the subject structure. In RA, RAO-20, R-1, PRD and RM Zoning Districts, the numbers shall be a maximum of six inches in height. In all other zoning districts, the numbers shall be a maximum of 12 inches in height.
All street numbers mounted to the wall of a building or to a porch or other fixed appurtenance shall be mounted at a height between four feet and 15 feet above the established grade. They shall be legible as to contrasting background, arrangement, spacing, size and uniformity of the whole, so that the numbers may be read with ease during daylight hours by a person possessing at least 20/40 vision, as the person views the number from the center line of the facing street and at an elevation of five feet above the finished surface thereof. Trees, shrubs or other obstructions shall not block said street numbers.
Where numbers are not visible with ease from the building's main parking lot or as required in § 195-3C of this chapter or where the building upon which the number is to be displayed is more than 150 feet from the edge of the right-of-way of the street or road serving the building, the number shall, in addition to the other requirements of this chapter, be displayed on a post readily visible from the main parking lot entrance or a public street. Numbers displayed on a post shall in no event be further back than 25 feet from said main parking lot or street right-of-way and shall be mounted at a height between four feet and six feet.
Where a group of structures or buildings carry the same address, each structure must bear a letter and/or number to provide a method of identification for each building. All building letters and/or numbers shall comply with all sections of this chapter.
The absence of house numbers or the insecure fastening or absence of any whole number thereof, or the use of any number out of logical sequence for the street toward which it faces, or the failure of a number to meet the elevation, visibility or other requirement as outlined in this chapter, shall be considered a violation of this chapter.
Final authority for determining and assigning the number or numbers to be used upon any particular premises is vested in the Code Enforcement Officer.
The Code Enforcement Officers are hereby declared to be responsible for the enforcement of this chapter. A notice of violation may be issued to the owner of each principal building not in compliance with this chapter.
If the owner of a property does not place said street numbers within 120 days after service of a notice of violation, the Code Enforcement Officer may issue an appearance ticket directing the owner to appear in Town Court in connection with the alleged commission of a violation of this chapter.
Any violation of this chapter shall constitute an offense punishable by a fine of not more than $50. The imposition of one penalty for a violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects at any such time. Each separate offense shall constitute a separate additional violation.
It is hereby declared to be the intent of the Chili Town Board that:
If a court of competent jurisdiction finds any provisions of this chapter invalid, in whole or in part, the effect of such decision shall be limited to those provisions which are expressly stated in the decision to be invalid, and all other provisions of the law shall continue to be separately and fully effective.
If a court of competent jurisdiction finds the application of any provision of this chapter to any building, other structure or tract of land to be invalid, in whole or in part, the effect of such decisions shall be limited to the person, property or situation involved in the controversy, and the application of any such provision to any other person, property or situation shall not be affected.
