Town of Chili property owners may apply for
a zoning permit to erect a nonpermanent structure within the boundaries
of a Town of Chili easement. Said permit shall be issued
upon conditions accepted by the applicant. These conditions shall
require that the Town of Chili shall at all times have access to said
easements and shall require the property owner to remove and bear
the cost of removing the structures permitted under the permit. It
shall also require the applicant to submit an instrument survey map
referencing the easement and the proposed nonpermanent structure.

The Code Enforcement Officer of the Town of
Chili is hereby authorized and directed to issue these zoning permits
on behalf of the Town of Chili after the permit application has been
approved by the Commissioner of Public Works and the Code Enforcement
Officer.
Neither the Code Enforcement Officer nor the
Commissioner of Public Works shall approve any such permit application
if, in their opinion(s), the proposed nonpermanent structure would
substantially interfere, delay or hinder the use, maintenance, access
or enjoyment of the easement by the Town of Chili.
The Commissioner of Public Works and the Code
Enforcement Officer may condition approval of the permit application
upon such further conditions which in their opinion are necessary
to protect the use, maintenance, access or enjoyment of the easement
by the Town of Chili.
