The Township of Rochelle Park recognizes the necessity of providing information to its public safety personnel regarding dangerous conditions that may exist when responding to emergencies. Because of this, the Township Committee directs, by this chapter, to require owners and occupants of multifamily dwellings to provide the type and size of respiratory equipment and its location.
As used in this chapter, the following terms shall have the meanings indicated:
MULTIFAMILY DWELLING
As defined in § 22-1, shall refer to any building containing three or more dwelling units.
OXYGEN SYSTEM
Any system used for respiratory purposes which shall comply with the requirements of N.J.A.C. 8:40-3.16(a)
RESPIRATORY EQUIPMENT
Any tank or container or cylinder containing oxygen. Cylinders, tanks or containers shall be of the kind and type approved for home medical care.
A. 
All owners or their agents shall obtain the following information relating to tenants or occupants that have in their possession respiratory equipment containing oxygen, which information shall be readily available to emergency service personnel:
(1) 
Name of occupant or tenant.
(2) 
Phone number of occupant or tenant.
(3) 
Apartment number or floor location of occupant or tenant.
(4) 
Type and size of oxygen container.
(5) 
Location in tenant or occupant's apartment of oxygen container.
B. 
Documentation of the above information shall be made available by the owner or its representative upon request by emergency service personnel of the Township of Rochelle Park.
Enforcement of this chapter shall be under the jurisdiction of the Fire Prevention Bureau.
A. 
Should the Fire Prevention Officer or his designee determine that there has been noncompliance with the conditions of this chapter, notification shall be given to the owner of the premises or its resident agent that compliance must occur within 15 days of the date of service of the notice. Should the owner or resident agent fail to comply after said notice, the Fire Prevention Officer or his designee shall be authorized to issue summonses returnable in the Municipal Court for violation of this chapter.
B. 
For a first offense, the penalty shall be not less than $50 nor more than $100.
C. 
For the second or subsequent offenses, the penalty shall be not less than $100 nor more than $500.
D. 
Each day of noncompliance shall be considered a separate violation.
