The following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGES
As defined in the Liquor Code of the Commonwealth of Pennsylvania (i.e., liquor, wine, malt, and brewed beverages).
OPEN CONTAINER
Any container from which consumption of an alcoholic beverage
is occurring.
PLCB
The Pennsylvania Liquor Control Board.
PUBLIC ACCESS PROPERTY
Any public street, alley, sidewalk, park, playground, ball
field, recreation areas, commons, or parking lots, including but not
limited to the Brookville Memorial Park, Northside Park, Walter Dick
Park and Longview Park.
Except as hereinafter provided, it shall be unlawful for any
person to drink an alcoholic beverage upon any public access property
within the Borough, and it shall be unlawful for any person to have
in such person's possession, or in a vehicle under such person's
control, any open container containing an alcoholic beverage upon
any public access property in the Borough.
Provided, however, that the provisions of §
58-2 shall not apply to premises duly licensed by the PLCB and to persons then and there patrons of said licensee, and provided further that the provisions of §
58-2 shall not apply when a special occasion permit shall be duly issued by the PLCB for an event to be held by the Brookville Volunteer Fire Company.
Any person who shall violate any of the provisions of this chapter
shall, upon conviction thereof before any District Justice, be sentenced
to pay a fine of not more than $600, plus costs of prosecution, and,
in default of payment of such fine and costs, to imprisonment for
not more than 30 days.
