[Amended 5-27-1986 by Ord. No. 25-1986]
No house, building or other similar structure
shall be moved into or through any street in the City without a written
permit therefor to be issued by the Director of Public Works by authority
of a resolution of the City Council.
[Amended 5-27-1986 by Ord. No. 25-1986]
No permit required by this article shall be issued until a written application therefor shall have been approved by the Director of Public Works, Chief Building Inspector and City Forester and filed with the Director of Public Works, accurately designating the size of the building or similar structure so to be moved, including the overall length, width and height, and the time required to complete such moving. In such application, the applicant shall agree to reimburse the City for all expenses incurred by the City for all damages to City property resulting from the moving of such building and shall agree that the Director of Public Works shall be the sole judge of the amount of the bond provided for in §
238-39 after securing such information as may be relevant from the Chief Building Inspector and the City Forester.
[Amended 5-27-1986 by Ord. No. 25-1986]
No permit required by this article shall be
issued until the applicant shall pay to the Director of Public Works
$100 as a permit fee. No such permit shall be issued until all real
property taxes assessed against the premises from which the building
is to be moved are paid.
Permits issued pursuant to this article shall
specify the streets to be used, shall limit the time in which such
moving shall be effected and shall contain such terms and conditions
as may be provided by the City Council.
[Amended 5-27-1986 by Ord. No. 25-1986]
No permit required by this article shall be
issued until a satisfactory bond shall have been filed with the Director
of Public Works, conditioned to indemnify the City against every loss,
expense, damage and liability by reason of such moving or the granting
of such permit.
Neither the house, building or similar structure
nor the apparatus used in moving the same shall unreasonably obstruct
any street or remain stationary nearer than 50 feet to any fire hydrant,
and no roadbed, pavement, curbing, tree or other public or private
property shall be disturbed or in any way damaged by such moving.
During the hours between sunset and sunrise,
every house, building or similar structure being moved and the apparatus
employed in moving the same shall be adequately guarded by lights
sufficient to notify and protect the public.
[Amended 5-27-1986 by Ord. No. 25-1986]
All work under this article shall be done under
the supervision of the Director of Public Works, provided that such
supervision by the Director of Public Works shall not relieve the
applicant of the liability expressed in this article, nor shall it
be used as a defense against the payment of any expenses or damage
resulting from the moving of such building.
