U-TURN
As used in this chapter, the following terms shall
have the meanings indicated:
A street having but one outlet for vehicular traffic without
special provision for turning around.

New Year's Day, Presidents' Day, Martin Luther King Day,
Good Friday, Memorial Day, Independence Day, Labor Day, Columbus Day,
General Election Day, Veterans' Day, Thanksgiving Day and Christmas
Day.

Any mechanical device or meter placed or erected for the
regulation of parking by authority of this chapter.

Turning the vehicle around so as to proceed in the opposite

Other words and phrases used in this chapter shall
have the same definitions as are provided in N.J.S.A. 39:1-1.

The Director of Public Works, when an appropriation
is provided therefor, is hereby authorized to provide for the installation
and maintenance of traffic control signs, signals and devices, when
and as required under the traffic ordinances of this City, to make
effective the provisions of said ordinances, subject to the approval
of the Director of Motor Vehicles. All traffic control signs, signals
and devices shall conform to the Manual on Uniform Traffic Control
Devices for Streets and Highways, published by the United States Department
of Transportation, Federal Highway Administration, and any other specifications
approved by the Director of Motor Vehicles. All signs and signals
required hereunder for a particular purpose shall, so far as practicable,
be uniform as to type and location throughout the City.
Flashing traffic control signals shall be installed
and operated at the intersections listed below. Such installation
shall be in accordance with the provisions of an Act Concerning Motor
Vehicles and Traffic Regulations, Subtitle One of Title 39 of the
Revised Statutes of the State of New Jersey, and shall conform to
the design of the State Department of Transportation, and shall be
maintained in operation as authorized by said Department.

A.
Purpose. This section is enacted to encourage drivers to strictly
obey traffic control devices at intersections, facilitating the flow
of traffic and protecting the safety and well-being of motor vehicle
occupants and pedestrians in the City of East Orange in full compliance
and accordance with the provisions of an act of legislature of the
State of New Jersey entitled "An Act Concerning Traffic Control Signal
Monitoring" and supplementing Title 39 of the Motor Vehicle Statutes
of the State of New Jersey, N.J.S.A. 39:4-8.12 et seq., and in accordance
with any rules and regulations enacted thereto or be enacted by the
Commissioner of the State of New Jersey's Department of Transportation,
the Chief Administrator of the State of New Jersey's Motor Vehicle
Commission, the Superintendent of the Division of the New Jersey State
Police and any Rules of Court that may be adopted by the Supreme Court
of New Jersey.
B.
Intent. It is the intent that all terms, conditions, requirements
of the program as established through N.J.S.A. 39:4-8.12 et seq.,
are specifically incorporated herein.
C.
Definitions. For the purpose of this section, words and phrases herein
shall have the same meaning as in N.J.S.A. 39:4-8.12 et seq., and
any rules and regulations of the Commissioner of the State of New
Jersey's Department of Transportation, the Chief Administrator of
the State of New Jersey's Motor Vehicle Commission, the Superintendent
of the Division of the New Jersey State Police and any Rules of Court
that may be adopted by the Supreme Court of New Jersey enacted pursuant
thereto.
D.
Installation.
(1)
The City of East Orange hereby determines to install and utilize
a traffic control signal monitoring system at various intersections
within the City of East Orange as approved by the Commissioner of
Transportation pursuant to the Act.
(2)
The system to be installed shall be approved by resolution of
the City Council of the City of East Orange.
(3)
The City of East Orange shall have the authority to enter into
a contract by resolution of the City Council of the City of East Orange,
following a lawful procurement process, for the installation of the
system. Any contract that contains provisions contrary to the Act
shall be null and void.

(4)
The signs notifying drivers that a system is being utilized
shall be approved by the City of East Orange's Department of Public
Works and shall be placed on each street converging into the affected
intersection as required by the Act. The sign shall be of a design
and placed in accordance with specifications determined and approved
by the Director of the City's Department of Public Works. The specifications
so approved shall conform with the uniform system set forth in the
Manual on Uniform Traffic Control Devices for Streets and Highways.

The City's Department of Public Works shall inspect and certify
the system at least once every six months from date of its installation.
E.
Issuance of the summons. The City of East Orange's Police Department
shall review the recorded images produced by the system to determine
whether sufficient evidence exists demonstrating that a traffic signal
violation has occurred and shall issue a summons when appropriate
in accordance with Title 39 of the New Jersey Statutes and the New
Jersey Rules of Court.
F.
Use of recorded images.
(1)
Except as otherwise provided in this section, the recorded images
produced by the system shall be available for the exclusive use of
the sworn officers of the East Orange Police Department for the purposes
of discharging said officers' duties pursuant to P.L. 2007, Chapter
348 (the "Act").
(2)
Any recorded image or information produced in connection with
the system shall not be deemed a public record under N.J.S.A. 47:1A-1
et seq., or common law. The recorded images shall not be:

Any recorded images or information collected in connection with
a traffic control signal violation shall not be retained after 60
days following the collection of any fine or penalty.
(4)
If a summons is not issued within 90 business days following
the traffic control signal violation, all recorded images and all
information collected with respect to the traffic control signal violation
shall be removed by the East Orange Police Department within three
business days.
(5)
The City of East Orange shall certify compliance to this section
by filing a report with the Commissioner of the State of New Jersey's
Department of Transportation in accordance with the Act.
G.
Locations.
(1)
Upon approval by the State of New Jersey's Department of Transportation,
traffic control signal monitoring systems may be utilized and operated
at the following locations:
(a)
Freeway Drive East and South Harrison Street.
(b)
Freeway Drive East and South Clinton Street.
(c)
Freeway Drive West and South Walnut Street.
(d)
Freeway Drive East and South Arlington Avenue.
(e)
Central Avenue and South Munn Avenue.
(f)
Central Avenue and Shepard Avenue.
(g)
Central Avenue and Halsted Street.
(h)
Central Avenue and Steuben Street/South 18th Street.
(i)
Sanford Street and Tremont Avenue.
(j)
Park Avenue and Prospect Street.
(k)
Park Avenue and Washington Street.
(l)
Park Avenue and East Park Street.
(m)
Park Avenue and North Clinton Street.
(n)
Park Avenue and North Grove Street.
(o)
South Grove Street and Winthrop Terrace.
(p)
Dodd Street and Glenwood Avenue.
(q)
Rhode Island Avenue and South Clinton Street.
(r)
South Orange Avenue and South Clinton Street.
H.
Amendments to list of locations. Any amendments, additions, deletions
or modifications to the list of locations shall be by amending ordinance
submitted to the City Council of the City of East Orange.
I.
Liability. The liability of the owner and operator of a motor vehicle
for a traffic control signal violation summons pursuant to the system
shall be joint, subject to provisions of the Act.
J.
Repealer. Any ordinance or parts thereof inconsistent with this section
are hereby repealed.
K.
Effective date; expiration date. This section shall take effect upon
final passage and publication and in accordance with the laws of the
State of New Jersey and shall expire upon the terms and conditions
set forth in N.J.S.A. 39:4-8.18.
L.
Statement. This section establishes a pilot program as authorized
by P.L. 2007, Chapter 348 (the Act), an act of the Legislature of
the State of New Jersey determining that the installation of a traffic
control signal monitoring system by municipalities complements local
law enforcement and could serve as an effective tool in encouraging
drivers to observe and obey traffic control devices at intersections,
thereby increasing traffic flow and occupant and pedestrian safety,
and establishes the various intersections within the City of East
Orange to install the system.

The Director of Public Works is hereby authorized:
A.
To designate and maintain, by appropriate devices,
marks or lines upon the surface of the roadway, crosswalks at intersections
where, in his opinion, there is particular danger to pedestrians crossing
the roadway, and at such other places as he may deem necessary.
B.
To establish safety zones of such kind and character
and at such places as he may deem necessary for the protection of
pedestrians subject to the approval of the Director of Motor Vehicles.
C.
To mark lanes for traffic on street pavements at such
places as he may deem advisable, consistent with the traffic ordinances
of this City.
