A. 
There shall be a Department of Planning, headed by a Commissioner. The method of choosing the Commissioner shall be as provided in § C5.01 of Article V of the Charter.
B. 
The Commissioner shall either be a graduate of an accredited college or university with a B.A. degree in planning or a related professional field and have not less than four years' administrative or consultant experience in the field of metropolitan, regional, County or municipal planning or have a satisfactory equivalent combination of training and experience.

The Planning Commissioner shall develop a capital program for Rockland County, assist in the planning of all capital projects and have and exercise all the powers and duties for a County, metropolitan or regional planning board as contained in the General Municipal Law and/or heretofore or hereafter lawfully granted or imposed by the Charter, this code, local law, ordinance or resolution of the County Legislature, or by any applicable provision of any act of the State Legislature, not inconsistent with the Charter or this code. The Planning Commissioner shall also perform such other related functions as the County Legislature or the County Executive may designate in order to implement and accomplish the policies and responsibilities the County Legislature has prescribed. The Commissioner of Planning shall also head the Department of Public Transportation and carry out the duties of the Commissioner of Public Transportation outlined in Article XXII of this code.

On or before March 1 of each year, the Commissioner of Planning shall make an annual report for the immediately preceding calendar year, covering generally the work of his or her Department. The Commissioner shall make such other reports at such times as may be required by the County Legislature, County Executive or any other applicable law. Copies of all reports shall be filed with the Clerk to the County Legislature and the County Executive.
A. 
There shall be a Planning Board consisting of nine members appointed by the County Executive for a term of four years, subject to confirmation by the Legislature. Of the members first appointed to the Planning Board, two shall hold office for the term of one year; two shall hold office for terms of two years; two for terms of three years; and three for terms of four years from and after their appointment. There shall be on the Planning Board at least one resident from each Town within the County. If a vacancy shall occur otherwise than by expiration of a term, it shall be filled by appointment for the unexpired term by the County Executive. The Chairperson of the Park Commission and the Chairperson of the Environmental Management Council shall serve as ex officio members of the Planning Board. The Chairperson of such Board shall be selected by the members of the Board for a term of one year. The Planning Board shall advise the Commissioner of Planning, the County Executive and the County Legislature in matters relating to planning and shall have and exercise such other and related duties required by the Commissioner of Planning, the County Executive and the County Legislature. The Planning Board shall be advisory to the Planning Commissioner in matters related to comprehensive metropolitan, regional, County and municipal planning.
B. 
The Planning Board shall elect each year, on or before the 15th day of January, a Chairperson, a Vice Chairperson and a Secretary. Meetings of such Board shall be held at the call of the Chairperson of the Planning Board or the County Executive on at least three days' written notice, mailed to the last known address of such Board members. The Board shall adopt rules of procedure for the conduct of its meetings and shall establish its regular meeting dates.
C. 
The members of the Planning Board shall receive no salary or compensation for their services but shall, within the appropriations provided therefor, be entitled to actual and necessary disbursements and expenses in performing the duties of their office.

All moneys to which the County may be entitled under and by virtue of the laws of the State of New York or which the Commissioner of Planning may receive for services or sale of work performed by his or her Department shall belong to the County and shall be collected by such Commissioner, accounted for and paid over to the Commissioner of Finance by a written statement within 10 days after the expiration of each month. Each monthly statement shall have attached thereto a certification by the Commissioner of Planning to the effect that the same is in all respects a full and true statement of all moneys received by him or her for the preceding month. At the time of rendering any such statement, the Commissioner of Planning shall pay to the Commissioner of Finance all moneys received by him or her since the last preceding monthly statement. Other funds or fees received or collected by the Commissioner of Planning shall be paid over and reported to the Commissioner of Finance as above provided, except where otherwise specifically provided by statute.
A. 
The Commissioner of Planning, within the appropriations provided therefor, shall appoint such officers, assistants and/or employees in his or her Department, including such actual deputy positions as may be authorized and budgeted, as shall be authorized by the County Legislature. All Deputy Commissioners of Planning shall serve at the pleasure of the Commissioner of Planning subject to all applicable provisions of New York State law.
B. 
The Commissioner of Planning shall designate and deputize a deputy or deputies to whom shall be delegated all the powers and duties of the Commissioner of Planning and the authority to act generally for and in place of said Commissioner of Planning.
C. 
The designation or designations shall be in writing and shall designate the relative rank of the deputies, including the order of temporary succession to the duties of the Commissioner of Planning during absence, disability or otherwise and also may delegate among them such powers and duties as he or she may determine. The designation(s) and delegations shall be in writing and filed in the Department of Records, and copies thereof shall be filed with the Clerk to the County Legislature and with the County Executive.
