There shall be a Department of Personnel, headed by a Commissioner of Personnel. The term of office shall be as prescribed in § 15, Subdivision b, of the Civil Service Law of the State of New York. Pursuant to §
C6.01 of Article
VI of the Charter, the Commissioner of Personnel shall be appointed by the County Executive, subject to confirmation by the County Legislature. Throughout his or her term of office, the Commissioner of Personnel shall hold no elective office and shall hold no other public office.
On or before March 1 of each year, the Commissioner
of Personnel shall make an annual report for the immediately preceding
calendar year, covering generally the work of his or her Department.
The Commissioner of Personnel shall make such other reports at such
times as may be required by the County Legislature or the County Executive.
Copies of all reports shall be filed with the Clerk to the County
Legislature and the County Executive.
The Commissioner of Personnel may request the
New York State Civil Service Commission to render technical advice
and assistance or its services in the preparation and rating of examinations
and the establishment of eligibility lists for all positions under
his or her jurisdiction.
The head of each administrative unit shall furnish
to the Commissioner such information as may be necessary for the proper
administration of the Department of Personnel.
The Commissioner of Personnel shall establish
and maintain a roster of all County officers and employees. Such roster
shall show, for each County officer and employee, the date of appointment
or election, the title or position, the rate of pay and rate changes,
promotions, demotions, transfers, the time and cause of separation
from County employment and any other information the Commissioner
considers necessary for the proper administration of the Department
of Personnel.
No payroll for salaries and compensation of County employees and officers shall be approved by the Commissioner of Finance unless certified by the Commissioner of Personnel that said employees and officers named therein have been employed during the period specified in their respective positions and in accordance with the Charter and this code and any law and rules applicable thereto. This certification shall be in addition and subsequent to the certification required by an administrative head pursuant to §
5-50B(4) of Article
V of this code.
The Commissioner of Personnel shall serve the
County Legislature and the County Executive as chief aide in all labor
relations matters, including but not limited to preparation of surveys
and materials necessary for the conduct of labor negotiations, service
on County negotiating teams, as required, and interpretation and everyday
administration of the terms of the various labor agreements between
the various unions and the County.
The Commissioner of Personnel shall serve the
County Legislature and the County Executive as chief aide in all personnel
matters, including but not limited to administration of the recruitment,
processing and termination procedure for all employees and personnel
surveys to include wages, hours and working conditions.
