All appointments to vacancies shall be filled
in accordance with the provisions of this chapter.
Examinations shall be in such form as will fairly
test the abilities and aptitudes of candidates for the duties to be
performed, and may not include any inquiry into the political or religious
affiliations or race of any candidate.

Candidates who qualify for employment shall be placed on a certified list for the appropriate job class in the rank order of the grade they obtained on the examination or, without sitting for the examination, may be selected by the Mayor or his designee and appointed based upon satisfaction of the requirements for said position as set forth in §§
27-11 and
51-7, including but not limited to previous experience in a classified position.
Vacancies in all classified positions shall
be filled by promotion whenever in the judgment of the Personnel Board
it is in the best interests of the Town to do so; such promotions
shall be on a competitive basis except where the Personnel Board finds
that the number of persons qualified for promotion is insufficient
to justify competition. Promotions shall give appropriate consideration
to the applicant's qualifications, record of performance and seniority.
Whenever it is not possible to certify the required
number of eligible persons for appointment to a vacancy in the classified
service because no appropriate list exists, the appointing authority
may nominate a person to the Personnel Board and, if such nominee
is found by the Personnel Board to have had experience and education
which appear to qualify him for the position and meets such other
requirements as are established by the personnel rules, he may be
temporarily appointed to fill such vacancy.
In case of emergency, an appointing authority
may make an emergency appointment of any person to any position without
regard to provisions of this article to carry on work that must be
continued in the public interest, but no such emergency appointment
shall continue beyond the time of the emergency as declared by the
Town Council. Emergency appointments shall be reported immediately
to the Personnel Board.
The Personnel Board shall maintain a list of
the names of all permanent and probationary employees who have been
removed from service or employment within the Town government for
lack of work or lack of funds. Such list shall be called a reemployment
list. Upon the restoration of necessary funds or work involved, within
one year from the date of his or her removal the employee shall be
returned to the position from which he was removed.
