No person, firm, partnership, corporation or
other entity shall operate a retail business, including but not limited
to places of trade or entertainment, between the hours of 1:00 a.m.
and 6:00 a.m. within the Town except as provided herein:
A. Any person, firm, partnership, corporation or other
entity possessing a business license issued by the Town may file an
application for a license for permission to operate a business between
the hours of 1:00 a.m. and 6:00 a.m. within the Town. Said application
shall be in writing, signed by the business owner, and shall be accompanied
by a statement describing the business, a description of the size
and location of the property and the proposed hours of operation,
and such further information required by the Town Council. Upon receipt
of said application, the Town Clerk shall docket the application for
hearing at a regularly scheduled meeting of the Town Council. At said
hearing on the application for licensing, the Town Council shall make
any such inquiry, inspection and investigation as it considers reasonably
required to ensure that the health, safety, welfare, peace and tranquility
of the public will not be adversely affected and the Town Council
may fix such conditions to the license as it deems reasonably required
for the protection of the public.
B. Any person, firm, partnership, corporation or other
entity possessing a license to serve alcoholic beverages may file
an application for a license for permission to open or operate for
business between the hours of 1:00 a.m. and 2:00 a.m. on Fridays,
Saturdays and nights before a legal state holiday pursuant to R.I.G.L.
§ 3-7-7.
(1) Said application shall be in writing, signed by the
license holder, and shall be accompanied by a statement describing
the business, a description of the size and location of the property
and the proposed hours of operation, and such further information
required by the Town Council.
(2) Upon receipt of said application, the Town Clerk shall
docket the application for hearing at a regularly scheduled meeting
of the Town Council.
(3) In accordance with R.I.G.L. § 3-7-7, any
such request for license shall be advertised by the Town Clerk in
a newspaper having a circulation within Providence County. All of
the costs associated with said advertising shall be paid by the applicant
as part of the application process.
(4) At said hearing on the application for licensing,
the Town Council shall make any such inquiry, inspection and investigation
as it considers reasonably required to ensure that the health, safety,
welfare, peace and tranquillity of the public will not be adversely
affected and the Town Council may fix such conditions to the license
as it deems reasonably required for the protection of the public.
Any license granted pursuant to this article
shall be subject to review and renewal on an annual basis.
Anyone convicted of a violation of any of the provisions of this article shall be punishable as provided in Chapter
1, General Provisions, Article
II, of this Code.
