In accordance with the provisions of R.I.G.L. § 23-18-10,
as amended, the Town Council does hereby prohibit further burials in that
certain burial ground described as follows: “Rhode Island Historical
Cemetery No. 65 located on Assessors Plat 15, Lot 114, on the northwesterly
side of Leading Street in the Town of Johnston, referred to as the Harris
Lot.”
In accordance with the provisions of R.I.G.L. § 23-18-10,
as amended, the Town Council does hereby order the owner of the burial ground
to cause to be removed therefrom the cadavers or remains of any persons buried
therein; cadavers and remains to be transferred to and interred in some other
cemetery within the State of Rhode Island.
Removal and interment shall be made under the direction of a qualified
registered funeral director and with the approval of the nearest of kin of
the deceased.
No cadaver or remains shall be removed as aforesaid unless notice is
given by certified mail to the nearest of kin known to the owner of the land,
and by advertising, in one or more newspapers having circulation within the
Town, at least once a week for three successive weeks.
In the event there shall be no nearest of kin known to the owner or
in the event the nearest of kin shall neglect to approve the removal and interment,
the owner and the State Health Department shall cause the cadavers or remains
to be removed, transferred and interred in such other cemetery in accordance
with the laws, rules and regulations of the religious denominations, if any
shall be known or ascertained, to which the deceased subscribed.
In adopting this article the Town Council finds that the area surrounding
the aforedescribed cemetery is compact and becoming thickly populated and
this section is necessary for preserving the health of the citizens of the
surrounding area and is in the interest of the public welfare of the citizens
of Johnston.
