Every person, firm, or corporation, unless licensed
as herein required, who shall as a hawker or peddler sell or offer
for sale any goods, wares or merchandise whatsoever, including food
and beverage, shall be fined $20 or imprisonment not exceeding 10
days.
A.
DOOR-TO-DOOR SALESPEOPLE
HAWKER
PEDDLER
As used in this article, the following terms shall
have the meanings indicated:
Persons who deliver goods, wares, or merchandise to customers
for which payment has already been made or is to be made at the time
of delivery.
Any person selling or offering for sale any goods, wares
or merchandise whatsoever, including any food or beverage, on any
public street, highway, or public right-of-way in the state from a
stationary location.
Any person selling or offering for sale any goods, wares,
or merchandise whatsoever, including any food or beverage, from a
vehicle, cart or any other conveyance which is not stationary.
B.
Persons selling farm or garden produce, including
flowers, and persons selling works of art or crafts of their own making
at an art or crafts show or exhibition are not deemed to be hawkers
or peddlers.
Hawkers and peddlers shall be prohibited from
offering for sale any goods, wares or other merchandise whatsoever,
including food and beverages, within a one-thousand-foot radius of
like or similar established business, and newly formed business which
buy or lease property for the purpose of establishing a business which
may be like or similar to that of a hawker or peddler.
The Town Council shall issue and revoke the
license of any hawker or peddler at its pleasure.
The fee for each license for a one-year period
or any part of the current year for selling or offering for sale as
a hawker or peddler shall be $75.
No license shall be required of any person,
firm or corporation selling religious books and publications on behalf
of bible, tract, or other religious or moral societies for the purpose
of promoting religious or moral improvement, and which are sold for
that purpose and not for pecuniary profit.
