There is hereby created the office of City Manager, an administrative
office of the City, as provided for and required by §§ 22 through
26 of the Charter of the City.
The City Manager shall be chosen and appointed by the Council.
The City Manager shall furnish a surety company bond to be approved
by the Council. The Council shall appropriate funds for the payment of the
premium for such bond.
The salary of the City Manager shall be fixed by the Council.
The City Manager may be removed by a majority vote of the entire Council.
The City Manager shall be responsible to the Council for the proper
administration of the affairs of the City.
The City Manager shall have authority to employ the necessary labor
and to purchase, acquire, hire or lease materials, tools, machinery, equipment,
vehicles and such other things as may be requisite to the performance of his
or her duties. The City Manager shall have authority to enter into contracts
for such services, materials and supplies as are provided for in the financial
budget of the City, except that as to any nonbudgeted contract involving the
sum of $5,000 or more, he or she shall first obtain the approval of the Council.
The City Manager shall be charged with the care and management of all
the real estate belonging to the City.
All municipal buildings and personal property shall be adequately insured
as the City Manager may direct.
The City Manager shall have the power to employ, manage, direct and
discharge all employees of the City, except those appointed by the Council
or constitutional officers and their employees.
The City Manager shall keep current a large and accurate map of the
City on which map shall be located, with engineering accuracy, streets, alleys,
water mains, sewer mains, fire hydrants and valves and such other information
as may be directed by the Council.
The City Manager shall keep the Council informed as to the financial
condition and future needs of the City.
The City Manager shall prepare and submit to the Council such reports
as it may require.
The City Manager shall attend all meetings of the Council and such meetings
of committees and boards as the Council may direct.
The City Manager shall perform, in addition to those duties imposed
upon him or her by the Charter and this Code, such duties as the Council may
prescribe by ordinance or resolution.
City Council will indemnify and save harmless the City Manager from
any personal liability, including reasonable counsel fees and the costs of
defense, of any action arising against the City Manager because of the execution
by the City Manager on behalf of the City of any contracts, agreements or
documents which the City Manager is authorized by City Council to execute
on behalf of the City and for personal liability as the result of any other
legal act of the City Manager performed within the scope of his or her employment
and the duties outlined in this article which is not otherwise covered under
any liability insurance contract in which the City and its employees are defined
as insureds.
