It shall be unlawful for any person to make or cause to be made a fire of leaves, trash or other inflammable matter within the City, except that:
A. 
Such leaves, trash or other inflammable matter may be burned in an approved incinerator on private premises with an attendant present, if located not less than 75 feet from any building; or
B. 
A permit may be granted by the City Council for a designated period of time with proper safeguards and regulations issued by the City Manager to authorize open burning of such leaves, trash or other inflammable matter.
It shall be unlawful for any person to blast within the City without first having received from the City Manager a written permit to do so. In blasting under this permit, all reasonable precautions shall be taken for the protection of persons and property.
The City of Lexington Planning and Development Department is hereby designated to act as the enforcing agency for the enforcement of the Statewide Fire Prevention Code duly adopted by the Virginia Board of Housing and Community Development under the authority of § 27-97 of the Code of Virginia.
The enforcement procedures of the Statewide Fire Prevention Code shall be instituted by the Fire Official when an unsafe condition is discovered by the Fire Official, or a report of an unsafe condition is made to the Fire Official, and will be administered in accordance with the provisions set forth in the Statewide Fire Prevention Code.
The City Building Code Board of Appeals is hereby designated as the appeals board to hear appeals arising from the application of the provisions of the Statewide Fire Prevention Code.
The Fire Official shall establish such procedures or requirements as may be necessary for administration and enforcement of this chapter. The procedures are to be approved by the City Manager.
