The City Manager hereby is directed to incorporate into the public parking lots and on the City streets the necessary markings and signage for the purpose of designating restricted parking zones in the City in accordance with the resolution adopted by the Mayor and Council at a regular meeting on July 10, 1986.

A. 
Fines and penalties set forth herein are as of the date of adoption of this section, all fines and penalties shall be as set forth in the City Budget for fiscal year 2017 to 2018 and effective beginning July 1, 2017.
B. 
All streets and public parking lots lined and marked with individual parking spaces, unless otherwise specified by signs, shall be limited to the time limit per space indicated by the signage. Any vehicle parked in the same restricted space for a continuous period in excess of the time indicated shall be subject to a fine of $15 for overtime parking, whether or not such parking space is on a City street or in a public parking lot. Such fine shall be paid to the City as indicated on the citation. A second offense for an overtime parking citation written within a twelve-month period shall result in a fine of $30, a third citation within a twelve-month period shall result in a fine of $60 and a fourth and any subsequent citation within a twelve-month period shall result in a fine of $120 and a fifth and any subsequent citation within a twelve-month period shall result a fine of $120 and the vehicle being towed. In the event that any citation is successfully contested, then such citation shall not be included in the computation set forth above. At the commencement of each new year, all violations that occurred within the previous year shall be ignored for the purposes of calculating the fine and the progression of fines as indicated herein shall commence anew.
C. 
It shall be unlawful for any person to refuse, fail or neglect to comply with any of the provisions of this chapter or any rule or regulation promulgated pursuant thereto.
D. 
Every person convicted of a violation of any of the other provisions of this chapter or any rule or regulation promulgated pursuant thereto, for which no other penalty is provided, shall, for a first conviction thereof, be punished by a fine of not less than $15 nor more than $120 or by imprisonment in jail for not less than one nor more than 10 days, or by both such fine and imprisonment; for a second such conviction within one year, such person shall be punished by a fine of not less than $20 nor more than $200 or by imprisonment in jail for not less than one nor more than 20 days, or by both such fine and imprisonment; and for a third or subsequent conviction within one year, such person shall be punished by a fine of not less than $50 nor more than $500 or by imprisonment in jail for not less than 10 days nor more than six months, or by both such fine and imprisonment.
E. 
Whenever a specific penalty is provided in the Code of Virginia for the violation of any section of the Code of Virginia adopted by reference by § 394-3, the penalty for a violation of such section, charged on a City warrant, shall be the same as provided by state statute.
