It shall be unlawful for the owners of vacant developed or undeveloped property located in any area zoned Suburban Residential in the unincorporated area of Warren County to permit grass, weeds and other foreign growth standing more than 15 inches in height to remain on so much of the property which lies within 100 feet of any dwelling or building. Any person who fails, refuses or neglects to cut or remove such grass, weeds and other foreign growth, after receiving reasonable notice to do so from the County Zoning Administrator or other properly designated official, shall be subject to a fine not to exceed $100.
In the event that prosecution of a violation of this Article is deemed by the Board of Supervisors to have been ineffectual in bringing about compliance with this section or is deemed by the Board to be impractical, the Board of Supervisors, after reasonable notice, may have such grass, weeds or other foreign growth which might endanger the health and safety of other residents of the county cut by its own agents or employees, in which event the cost thereof shall be chargeable to and paid by the owners of such property and may be collected by the county as taxes and levies are collected. Every charge authorized by this section with which the owners of any such property shall have been assessed and remains unpaid shall constitute a lien against such property.
The Board of Supervisors shall not be required to invoke its authority under § 104-2 but may choose to do so only in circumstances in which it deems such action necessary to protect the health and safety of the residents of the county.
