The established Police Department of the City of Hudson, Wisconsin,
shall consist of the Chief of Police and such supervisory officers and police
officers as the Council shall prescribe by ordinance or resolution. The Chief
of Police shall be appointed by the Police and Fire Commission. Supervisory
officers and police officers shall be appointed by the Chief of Police by
promotion or from an eligible list provided by, and subject to approval of,
the Police and Fire Commission. They shall receive such compensation as shall
be determined by ordinance or resolution, and such compensation shall be in
lieu of all special fees or remunerations arising from such police service.
A. The Chief of Police shall be the chief executive officer
of the Department and have direct control and management of all members of
the Department in the lawful exercise of their duties, subject to the provisions
of law and of city ordinances and subject to such other lawful written orders
of the Mayor or Common Council, as provided by law.
B. The Chief of Police shall be responsible for the maintenance
of order, the enforcement of laws and the ordinances and regulations of the
city, the prevention of crime and the protection of life and property. The
Chief shall maintain rigid discipline so as to secure complete efficiency
in the Department.
C. In the case of absence or disability of the Chief of
Police, the Captain of police shall be the acting Chief of Police; in the
case of absence or disability of the Captain, the Lieutenant of police shall
be the acting Chief of Police; and in the case of absence or disability of
the Captain and Lieutenant, the ranking Sergeant of police shall be the acting
Chief of Police, in such order, and such acting Chief of Police shall perform
the duties and exercise the power and authority of the Chief of Police but
shall be entitled to no additional pay.
The Chief of Police, at the Chief's discretion, may appoint supervisory
officers to command various shifts or departments within the Police Department.
The Chief of Police and each supervisory officer and police officer
shall perform such duties as may be required by law, ordinance or city regulation.

The Chief of Police shall adopt rules and regulations for the government,
discipline, equipment and uniforms of supervisory officers and police officers
and fix their duties. Proposed rules and regulations shall be reviewed by
the Public Safety Committee prior to implementation. The Chief of Police or
the Police and Fire Commission shall prescribe penalties for violations of
any such rules and regulations.
The Chief of Police or such supervisory officer or police officer or
subordinate assigned by the Chief shall keep an accurate and complete record
of all complaints, arrests, traffic violations and convictions and the disposition
of each case handled by the Department. The Chief of Police, or a supervisory
officer assigned by the Chief, shall keep a record of the accomplishments
and performances of each police officer.
The Chief of Police shall, at a time of the month designated by the
Mayor, submit to the Mayor and the Council a written report on all activities
and transactions of the Department during the preceding month and such recommendations
as the Chief shall deem advisable with respect to departmental personnel,
property or equipment or such other matters as the Chief shall consider to
affect the effective operation of the Department in the public interest, including
suggested ordinances. The Chief shall also submit, at the end of the calendar
year, an annual report and the departmental budget for the ensuing year.
The Chief of Police shall have custody, care and control of public property
and equipment of the Police Department, subject to the directions of the Mayor
and the Council. The Chief shall conduct personally, or through a supervisory
officer, periodic surveys of such property and equipment, and the Chief of
Police shall arrange for the salvaging of discarded or impaired items and
submit recommendations as to future needs to the Mayor.
All fees and other special remunerations received by the Police Department
or any member thereof shall be deposited with the Finance Officer and shall
constitute a special fund which shall be expended for equipment or property
for the Police Department by order of the Chief of Police, subject to the
approval of the Mayor.
Each member of the Police Department, while on a tour of duty, shall
wear a badge, uniform and sidearm and such other equipment as shall be prescribed
by the Chief of Police. Ranking officers, the Chief, Captain and Lieutenant,
and such other police officers as authorized by the Chief of Police may wear
appropriate civilian clothes while on duty but must carry the badge of their
office and must be suitably armed. Each member of the Police Department shall
be responsible for all city equipment issued to that member, and any member
who shall lose or destroy such equipment shall be required to pay the cost
of replacement. Whenever any member shall terminate membership in the Department,
all city equipment and property and the badge shall be delivered to the Chief
of Police. All sums of money due said member shall be withheld pending such
final settlement.
All members of the Police Department, except civilian employees, shall
be considered on duty at all times and subject to call by the Chief of Police
or supervisory officer assigned by the Chief and shall have the same power
and authority as during their regular tour of duty.
The Chief of Police shall be appointed in accordance with W.S.A. s.
62.13(3), and subordinates shall be appointed in accordance with W.S.A. s.
62.13(4)(a).
At any time, but not more than once in each calendar year, the Mayor
may require any member of the Police Department to file with the Clerk, on
a form to be furnished by the city, a signed written report by a physician
licensed to practice medicine and surgery in the State of Wisconsin as required
of candidates under W.S.A. s. 62.13(4)(c).
Each member of the Police Department shall be subject to suspension
without pay for a period not to exceed 30 days and also to demotion or removal
from office or employment as provided, in the case of the Chief of Police,
by W.S.A. s. 62.13(3) and (5)(a) through (i), where applicable, and (j), and,
in the case of subordinates, by W.S.A. s. 62.13(5)(a) through (j).
As provided by W.S.A. s. 62.09(8)(d), the Mayor may, in case of riot
or other emergency, appoint for a specified time as many special policemen
as may be necessary. During such term each special policeman shall possess
only those powers and perform only those duties as shall be specifically assigned
to him by the Chief of Police. Such term of appointment shall expire not more
than one week following the termination of such riot or other emergency.
All acting full-time police officers of the city who have served their
probationary period at the time of the passage of this chapter shall be deemed
permanent members of the Police Department of the city.
Any person who violates any provision of this chapter shall be subject to a penalty as provided in Chapter
1, §
1-18 of this Code.
