For the purposes of this chapter, the words
set out in this section shall have the following meaning:
DESTROY
the complete killing of weeds or the killing of weed plants
above the surface of the ground by cutting, at such time and in such
manner as will effectually prevent such plants from maturing to the
bloom or flower stage.
NOXIOUS WEEDS
Includes the following:
A.
Canada thistle, leafy spurge, field bindweed
(creeping Jenny), ragweed, bull thistle, burdock, cocklebur, pigweed,
hemp, and any other such weeds as the governing body by ordinance
or resolution declares to be noxious within its respective boundaries.
B.
Tall grass exceeding an average of six inches
in height, or vegetation providing safe harborage for rats, mice,
snakes, and other vermin.

C.
Noxious grasses, such as foxtail, redtop, orchard,
timothy, and johnson.
Every person shall destroy all noxious weeds
on all lands which he shall own, occupy, or control. The person having
immediate charge of any public lands shall destroy all noxious weeds
on such lands.

The Weed Commissioner or his designee shall
inspect or cause to be inspected all premises within the Village to
determine whether any noxious weeds, grass or brush as defined herein
exists. If the Weed Commissioner or his designee determines that such
noxious weeds, grass or brush does exist, he shall serve or cause
to be served upon the owner of the property a written notice to destroy
the noxious weeds, grass or brush within five days of the service
of the notice. If the owner does not destroy the noxious weeds, grass
or brush within the specified time, the Weed Commissioner shall cause
the same to be destroyed. The entire cost of the work performed by
the Village shall be chargeable to and assessed against the parcel
or lot affected.
