Whenever conditions exist which affect the availability of water so as to endanger the health, safety, and welfare of the persons and property within the Village, the Village Administrator, after consultation with the Public Works and Utility Director, shall by appropriate public media declare the beginning of a water emergency and the application of emergency water regulations, which regulations shall remain in force and effect until lifted by the Village Administrator. For the purposes of this article, a water emergency shall exist whenever the Water Utility is unable to provide sufficient water to meet the normal usage needs of the municipality and its citizens due to drought, mechanical failure, or other like kind of conditions.
Emergency water regulations mean there shall be no water usage for swimming pools, birdbaths, fountains, ponds, car washing, lawns and gardens except as hereinafter provided.
Irrigation and/or usage for agricultural or commercial uses, such as, but not limited to, strawberry patches, tree farms, and vegetable plots, shall be allowed for those persons or entities who or which have obtained a permit from the Village Board. This section shall not be applicable to personal use gardens. Upon receipt of the application the Village Board shall consider the same at its next regularly scheduled meeting. The application for a permit shall contain the following information:
A. 
The name and address of the applicant.
B. 
A description of the site location for the proposed irrigation.
C. 
The requested times and days for such irrigation.
D. 
A brief statement setting forth the applicant's need for the requested hours of irrigation, an estimate of the amount of water usage on a per-hour basis, and the type of irrigation method to be employed.
E. 
Such other information as may be required by the Village Board as necessary to determine and provide for the adequate conservation of the water resources of the Village.
Birdbaths, ponds, fountains, and swimming pools, all of which do not exceed 20 gallons in capacity, and pools located in school buildings are excepted from these regulations.
The Village Administrator shall disseminate as fully as possible, including news bulletins to local radio and television stations, news bulletins to local newspapers, and by other appropriate means, any statement that a water emergency exists and shall set forth the restrictions regulating water usage.
Any person who shall violate any provision of this article shall be subject to a penalty as provided in Chapter 1, § 1-12 of this Code.
