Any elected official in the Town of Madison, except a School Board member,
may be recalled and removed from office by the qualified voters of the Town
as herein provided.
The form of the ballot for the recall election shall be as follows:
"Shall [insert name of person subject to recall] be recalled from
the office of [insert name of office]?"
and shall contain two separate boxes, one for a "Yes" vote
and one for a "No" vote. There shall be a separate question for
each official whose recall is being sought. Under the question(s) there shall
appear the word "CANDIDATES" and the direction "VOTE FOR
[insert number of officials subject of recall election]", and beneath
this the names of candidates nominated, listed alphabetically by last name.
In the event that a municipal official is recalled, the candidate(s) receiving
the greatest number of votes shall be deemed elected.

Any official whose recall is being sought shall not be a candidate at
the recall election. The nomination of candidates, the publication of the
Warrant for the recall election, and the conduct of the recall election shall
be conducted in accordance with the provisions of the laws of the State of
Maine.
Unless the official whose recall is being sought resigns, the incumbent official shall continue to exercise all of the privileges and duties of the office until the results of the recall election are certified. If not recalled, the official shall continue in office for the remainder of the unexpired term, subject to subsequent recall only as provided in §
120-9 of this chapter. If recalled in the recall election, the official shall be deemed removed from office upon the certification of the recall election results.
No recall petition shall be filed against an elected official within
four months after such official first takes office. In the case of an official
subject to a recall election and not removed thereby, no recall petition shall
be filed against the official until at least six months after the recall election.
The invalidity of any provision of this chapter shall not invalidate
any other provision.
