The Mayor and Council, on a case-by-case basis, may waive or discount water/sewer impact fees for property owners that:
A. 
Upgrade building structures in the floodplain; or
B. 
Upgrade under- or non-utilized properties within one or more of the following criteria:
C. 
The cost of the upgrade is more than 50% of the fair market value of the property;
D. 
The structure is more than 15 years old and has been vacant for not less than the preceding 12 months; or
E. 
The property is not habitable in its existing condition and the renovations are in compliance with the existing Building Code of the Town of Federalsburg.[1]
And provided the property owner has completed renovations of the property which are more than 50% of the fair market value of the property and which are in compliance with applicable floodplain regulations and/or existing Building Codes.[2]

The Mayor and Council may waive water and sewer impact fees and/or related expenses for those properties that are required by Chapter 235, Water and Sewer, Article I, to connect to that public water and sewer line if it is deemed to create a hardship for the property owner. Hardship cases will be based on income levels. The income levels should be the low/moderate-income levels as set forth by the most recent Department of Housing and Urban Development figures. The Mayor and Council of Federalsburg shall as an incentive to allow property owners to upgrade structures may grant to the property owner(s) a three-year tax exemption, after upgrade of said structure, beginning July 1 of the first year after complete renovations have been made and provided that the renovations comply to the Town's Building Codes. Said exemption may be granted, provided that the property owner upgrades by 50% of the fair market value. Said exemptions shall be made on a case-by-case basis.
Representatives of the Town may assist said property owners to obtain funding to upgrade properties on which structures that have become dilapidated, decayed, unsafe, unsanitary or which fail to provide the amenities essential to decent living and are unfit for human habitation, or are likely to cause sickness or disease, so as to result in injury to the health, morals, safety or general welfare of those living therein.
