Whenever a term is used in this chapter which is defined
in N.J.S.A. 40:55D-1 et seq., such term is intended to have the meaning
set forth in the definition in said statute, unless a contrary intention
is clearly expressed in context or a definition in this section sets
forth a clarification or limitation for the purposes of this chapter
within the authority granted by said statute. Other terms set forth
in this section shall have the meanings indicated, unless a contrary
intention is clearly expressed in context.
ACCESSORY SOLAR ENERGY FACILITY
A solar facility, used to generate electricity that is accessory
to a principal use or structure on the same property.

ACCESSORY USE OR STRUCTURE
A subordinate use or structure, the purpose of which is incidental
to that of the main use or structure and on the same lot therewith.
ACCESSORY WIND ENERGY FACILITY
A wind facility, used to generate electricity that is accessory
to a principal use or structure on the same property.

ADMINISTRATIVE OFFICER
The Secretary of the Planning Board in the case of matters
involving the Planning Board; the Secretary of the Board of Adjustment
in the case of matters involving the Board of Adjustment; the Municipal
Clerk in the case of matters involving the governing body; and the
Zoning Officer in the case of matters involving the issuance of zoning
permits and certificates of occupancy and Zoning Ordinance enforcement.
ALTERNATIVE TREATMENT CENTER
An organization issued a permit pursuant to the Jake Honig
Compassionate Use Medical Cannabis Act, P.L. 2009, c. 307 (N.J.S.A.
24:6I-1 et seq.) to operate as a medical cannabis cultivator, medical
cannabis manufacturer, medical cannabis dispensary, or clinical registrant,
as well as any alternative treatment center deemed pursuant to Section
7 of that act (N.J.S.A. 24:6I-1 et seq.) to concurrently hold a medical
cannabis cultivator permit, a medical cannabis manufacturer permit,
and a medical cannabis dispensary permit.

ANCHOR USE
A major use within a shopping center that serves to attract
patrons and stimulate activity among commercial uses within the center.

BASEMENT
A story of a building that is partly underground, which has
more than 1/2 its interior height, measured from the floor to finished
ceiling, below the average finished grade of the ground adjoining
the building.
BLOCK
A block is the length of one side of a street between two
street intersections.
BUILDING
As defined in N.J.S.A. 40:55D-1 et seq., and including tents,
lunchwagons, trailers, dining cars, camp cars or other structures
on wheels or other supports.
BUILDING COVERAGE
The ratio of the horizontal area measured from the exterior
surface of the exterior walls of the ground floor of all principal
and accessory buildings on a lot to the total lot area. Building coverage
is expressed as a percentage of the total lot area.

BUILDING HEIGHT
The vertical dimension measured from the average elevation
of the finished lot grade at the front of the building to the highest
point of ceiling of the top story in the case of a flat roof; to the
deck line of a mansard roof and to the average height between the
plate and ridge of a gable, hip or gambrel roof.
BUILDING SETBACK LINE
The line parallel to the street at a distance therefrom equal
to the depth of the front yard required for the district under consideration.
CAMPGROUND, PRIVATE
A facility operated for profit providing the natural setting
upon which two or more campsites are located, established or maintained
for outdoor living in tents, camp trailers or camp cars, but not mobile
homes, for periods of temporary occupancy by the general public for
a total of 15 days or more in any calendar year for recreation, education
or vacation purposes. Occupancy of any campsite or campsites in a
particular campground by the same person or persons shall not be permitted
for more than a total of 15 days out of any 30 days during the period
from September 1 to June 1.
CANNABIS
All parts of the plant Cannabis sativa L., whether growing
or not, the seeds thereof, and every compound, manufacture, salt,
derivative, mixture, or preparation of the plant or its seeds, except
those containing resin extracted from the plant. This does not include
medical cannabis or hemp products.

CANNABIS CONSUMPTION AREA
A designated location operated by a licensed cannabis retailer
or permit holder for dispensing medical cannabis, for which both state
and local endorsement has been obtained, that is either:

(1)
An indoor, structurally enclosed area of the cannabis retailer
or permit holder that is separate from the area in which retail sales
of cannabis items or the dispensing of medical cannabis occurs; or
(2)
An exterior structure on the same premises as the cannabis retailer
or permit holder, either separate from or connected to the cannabis
retailer or permit holder, at which cannabis items or medical cannabis
either obtained from the retailer or permit holder, or brought by
a person to the consumption area, may be consumed.
CANNABIS CULTIVATOR
Any licensed person or entity that grows, cultivates, or
produces cannabis in this state, and sells, and may transport, this
cannabis to other cannabis cultivators; or usable cannabis to cannabis
manufacturers, cannabis wholesalers, or cannabis retailers, but not
to consumers. This person or entity shall hold a Class 1 cannabis
cultivator license.

CANNABIS DELIVERY SERVICE
Any licensed person or entity that provides courier services
for consumer purchases of cannabis items and related supplies fulfilled
by a cannabis retailer in order to make deliveries of the items to
the consumer. This person or entity shall hold a Class 6 cannabis
delivery license.

CANNABIS DISTRIBUTOR
Any licensed person or entity that transports cannabis in
bulk intrastate from any one class of licensed cannabis establishment
to another class of licensed cannabis establishment. This person or
entity shall hold a Class 4 cannabis distributor license.

CANNABIS MANUFACTURER
Any licensed person or entity that processes cannabis items
in this state by purchasing or otherwise obtaining usable cannabis,
manufacturing, preparing and packaging cannabis items, and selling,
and optionally transporting, these items to other cannabis manufacturers,
wholesalers, or retailers, but not consumers. This person or entity
shall hold a Class 2 cannabis distributor license.

CANNABIS RETAILER
Any licensed person or entity that purchases or otherwise
obtains usable cannabis from cannabis cultivators and cannabis items
from cannabis manufacturers or wholesalers, and sells these to consumers
from a retail store, and may use a cannabis delivery service. This
person or entity shall hold a Class 5 cannabis retailer license.

CANNABIS WHOLESALER
Any licensed person or entity that purchases or otherwise
obtains, stores, sells or otherwise transfers, and may transport,
cannabis items for the purpose of resale or other transfer to either
another wholesaler or retailer, but not to consumers. This person
or entity shall hold a Class 3 cannabis wholesalers license.

CHANNEL
The bed and banks of a stream which convey the normal flow
of the stream.
CLUB
Any organization catering exclusively to members and their
guests, or any organization for religious, vocational, civic or recreational
purposes which is not conducted for financial gain.
CLUSTER DEVELOPMENT
A subdivision for single-family homes for which, on the basis of standards included in §
212-45, zoning standards otherwise applicable may be reduced for the purposes of providing a more compact service area and the retention of sizable areas of common open space.
COMMERCIAL SOLAR ENERGY FACILITY
A solar energy system which exists as a principal use to
generate electricity, heat water, and/or produce hot air for use on
site or off site, with electricity delivered by distribution and/or
transmission lines.

COMPRESSED NATURAL GAS FUELING FACILITY[Added 9-15-2021 by Ord. No. 988]
(1)
A facility wherein natural gas, provided by a standard domestic
service gas utility pipeline, is metered to equipment that processes
the gas into a compressed form that is ready for distribution into
vehicles that are specially equipped to be fueled by the resulting
compressed natural gas product. A compressed natural gas fueling facility
is not a gasoline service station, a liquefied natural gas facility
or a truck stop service center. A compressed natural gas fueling facility
may include:
(a)
A slow-fill component that is fully secured and screened, accessible
only by preapproved fleet companies and utilized for filling authorized
vehicles during a prolonged, predetermined and scheduled period of
time (typically overnight); and
(b)
A fast-fill component that is available 24 hours per day, seven
days per week.
(2)
Both the slow-fill and fast-fill components can include video
surveillance, automated safety shutoff with fire protection systems
consistent with NFPA 52 along with remote monitoring for safety and
performance.
CONDITIONAL USE
A use permitted in a particular zoning district only upon showing that such use in a specified location will comply with the conditions and standards for the location or operation of such use as contained in the Zoning Ordinance and upon the issuance of an authorization therefor by the Planning Board. Every applicant submitting an application for conditional use approval shall satisfy the general requirements of §
212-67 of the Carneys Point Township Zoning Ordinance, as well as said specific conditions and standards as may be set forth in the Carneys Point Zoning Ordinance.

DEPARTMENT STORE
An enclosed retail store containing a variety of merchandise
and retail categories.

DWELLING
A building designed or used primarily for family residence.
The word "dwelling" shall not include boarding or rooming houses,
hotels, motels or other structures designed or used for transient
residence.
DWELLING UNIT
A building or part of a building used as a dwelling by a
single family, including equipment for cooking or provisions for the
same.
EFFICIENCY FACILITIES
A combination of installations, appliances and furniture
in a hotel or motel unit of accommodation that create a homelike atmosphere
and provide some of the practical conveniences typically enjoyed in
a residence, such as a living/dining area where food can be stored,
prepared and consumed. Efficiency facilities may include a kitchenette
area with countertop stove-top having no more than two burners with
automatic off-on switch; a microwave oven; a toaster; a coffeemaker;
and a seating area with dining table and chairs. Efficiency facilities
may not include cooking ovens other than a microwave oven, cooking
stoves or burners other than a built-in countertop two-burner stove-top;
dishwasher; trash compactors; clothes washers/dryers; or other major
appliances. Efficiency facilities may not be occupied for periods
exceeding 30 days or as temporary or permanent primary residences
or dwellings. Each such efficiency unit must contain a minimum of
250 square feet.

ESSENTIAL SERVICES
Underground gas, electrical, telephone, telegraph, steam
or water transmission or distribution systems, including mains, drains,
sewers, pipes, conduits and cables; and including normal aboveground
appurtenances such as fire alarm boxes, police call boxes, light standards,
poles, traffic signals, hydrants and other similar equipment and accessories
in connection therewith, reasonably necessary for the furnishing of
adequate service by public utilities or municipal or other governmental
agencies or for the public health or safety or general welfare,

FAMILY
One or more persons occupying a single housekeeping unit
and using common cooking facilities, provided that, unless all members
are related by blood, marriage or adoption, no family shall contain
over six persons except as per N.J.S.A. 40:55D-66.
FARM BUILDING
Any buildings used for storing agriculture equipment or farm
products or housing livestock or poultry. The term "farm building"
shall not include a residential dwelling.
FAST-FOOD/DRIVE-THROUGH ESTABLISHMENT
A commercial establishment where food and drink are prepared
on the premises for consumption within the restaurant or off the premises.
Any restaurant established with a drive-through window shall be considered
a fast-food/drive-through restaurant.

FENCE OR WALL
A structure which permanently or temporarily prohibits or
inhibits unrestricted travel between properties or portions of properties
or between the street or public right-of-way and a property.
FLOOR AREA, HABITABLE
An area fully enclosed by the inside surfaces of walls, windows,
doors and partitions and having a head room of at least six feet six
inches, including living, eating, cooking, sleeping, storage, circulation,
service, utility and other related household spaces, but excluding
garages, carports, porches, unheated sheds and basements. Attics or
portions thereof may be considered habitable floor area, provided
that they are fully finished and meet the proper height requirements.
FLOODPLAIN
The area adjoining any natural stream and including any water
or drainage course or body of water subject to periodic flooding or
overflow.
FLOODWAY
Any portion of a floodplain lying within 100 feet of the
edge of a natural stream or within 50 feet from the edge of any watercourse
other than a natural stream.
GARDEN APARTMENT
A multiple-family dwelling structure not more than two rooms
in depth, or 2 1/2 stories in height, designed as part of a residential
project under single management, providing joint or common use of
open areas by occupants, whether for recreation, parking or other
purposes.
GASOLINE SERVICE STATION
Any area of land, including the structures thereon, used
for the retail sale of petroleum products or sale of motor vehicle
accessories and services.
GENERAL PURPOSE AGRICULTURE
Any parcel of land of five acres or more that is used for
the gainful production of agricultural or horiticultural products,
livestock, poultry and resultant products, but excluding an intensive
fowl or livestock farm.
GROSS ACREAGE
The total acreage of the site to be developed, excluding
land subject to utility or drainage easements or within floodways
as defined in this chapter.
GROSS FLOOR AREA
The sum of the gross horizontal areas of the several floors
of a building or structure from the exterior face of exterior walls,
or from the center line of a wall separating two buildings, but excluding
any space where the floor-to-ceiling height is less than six feet.

GROSS LEASABLE FLOOR AREA
The total floor area designed for tenant occupancy and use,
including basements, mezzanines and upper floors, if any, expressed
in square feet measured from center lines of joint partitions and
exteriors of building walls.

HOME OCCUPATION
An occupation or profession which is clearly incidental to
the use of the lot and dwelling for residential purposes; is carried
on by a member of the family residing on the premises; does not involve
more than one employee not living on the premises; does not occupy
more than 20% of the principal residential structure nor more than
300 square feet of any accessory structure; does not have any exterior
evidence of such secondary use in trade outside of a principal or
accessory building. In connection with the operation of a home occupation,
only external operations which are customary to residential buildings
shall be permitted. In the case of any home occupation involving customer
or patient visitation, adequate off-street parking shall be provided
in conformance with standards contained in this chapter.
IMPERVIOUS AREA
The surface area of a lot covered by buildings and structures
and by accessory buildings or structures. “Impervious area”
shall include all parking areas, sidewalks, walkways, patios, automobile
access driveways, and/or storage areas, whether or not covered by
an impervious surface, and all other impervious surfaces. The impervious
area of a lot expressed as a percentage is equal to lot coverage.

INTENSIVE FOWL OR LIVESTOCK FARM
A farm on which are kept more than a total of 200 head of
adult large animals; or 50 head of small animals; or 10 head of fowl
per acre; or one adult and up to one replacement large animal per
each two acres; or two small animals per acre. "Large animals" shall
include beef and dairy cattle, horses and mules. "Small animals" shall
include pigs, sheep, goats and calves up to an age of one year.
JUNKYARD
The use of more than 1,000 square feet in the case of an
agricultural parcel or more than 200 square feet of any other lot
or the use of any portion of that half of any lot adjoining a public
thoroughfare for the storage, keeping, processing or abandonment of
wastepaper, rags, scrap metal or other discarded material or for the
dismantling, demolition or abandonment of automobiles, other vehicles,
machinery or parts thereof.
KENNEL
Any building or land parcel used for the keeping of dogs
and/or other household pets. The keeping of more than five such adult
animals on any one property shall be deemed to constitute a "kennel."
LAND-MINING OPERATION
The removal of sand, gravel, clay or other materials from
the ground for sale or other commercial or industrial purpose other
than such as may be incidental to any permitted agricultural use or
to excavating or regrading in connection with or anticipation of building
development or landscaping a building site, and shall be deemed to
include all operations customarily involved in connection with such
removal.
LIGHT MANUFACTURING
The fabrication, assembly or processing of goods or materials
or the storage of bulk goods and materials where such activities or
materials create no hazard from fire or explosion or produce no toxic
or corrosive fumes, gas, smoke, obnoxious dust or vapor, offensive
noise or vibrations, glare, flashes or objectional effluent.

LOADING SPACE
Any off-street space not less than 12 feet in width, 60 feet
in length and 14 feet in height, available for the loading or unloading
of trucks, having direct access to a street or alley and so arranged
that no vehicle is required to back into a street.
LOT
Any area of land occupied, or to be occupied, by one principal
building and its accessory buildings, and including the open space
required under this chapter, except that uses inherently involving
more than one principal building only may occupy a single lot. Any
portion of a lot included within 25 feet of the center line of a public
right-of-way shall not be included in calculating any maximum-minimum
building standard.
LOT, CORNER
A lot bounded on two or more sides by a public right-of-way.
LOT COVERAGE
The impervious area of a lot. Lot coverage is expressed as
a percentage of the total lot area.

LOT, DEPTH
The mean horizontal distance between the front and rear lot
lines, measured in the general direction of the side lot lines.
LOT LINE, FRONT
The right-of-way of the street or road on which the lot fronts
or abuts.
LOT LINE, FRONTAGE
The horizontal distance measured along the full length of
the front lot line. In the case of a corner lot adjoining a major
and minor street, the property line abutting the minor street shall
be considered as the "frontage."
LOT LINE, REAR
A lot line other than a street line which is the farthest
lot line from the street. In the case of a lot abutting on two streets,
required front yard setbacks from both streets shall be required.
LOT LINE, SIDE
Any lot line not a front lot line or a rear lot line, including
the outer boundaries of an offset portion of a lot.
LOT WIDTH
The distance between the side lot lines measured at right
angles to the depth of the lot, either along the lot frontage or at
the minimum front yard setback line.
MANUFACTURING
The treatment or processing of raw products and the production
of articles or finished products from raw or prepared materials by
giving them new form or qualities.

MIGRANT LABOR HOUSING
Any farm building, other than a principal dwelling, which
complies with state and local migrant housing laws, used or intended
for use on a temporary basis as a place of abode for farm laborers.
MOBILE HOMES
A vehicle used or so constructed as to permit its being used
as a licensed conveyance upon public streets or highways and being
constructed in such a manner as will permit its occupancy as a place
of day-to-day habitation for one or more persons. This term shall
also include automobile trailers, house trailers and trailer coaches,
excepting therefrom travel trailers.
MODULAR HOME
A preconstructed dwelling unit constructed off premises in
sections that complies with Municipal Building Code requirements for single-family dwellings.
MOTOR VEHICLE TRAVEL CENTERS
A use providing a mix of services to automobile, truck and recreational vehicle operators, including the sale of gasoline and diesel fuel, the retail sale of food and of vehicle related supplies and convenience items and the operation of restaurant facilities. Such uses shall specifically not include overnight accommodations such as hotels or motels. Motor vehicle travel centers, as conditional uses, shall be subject to the general provisions of the Carneys Point Township Zoning Ordinance §
212-67, as well as the specific conditions and standards for gasoline service stations and all other applicable provisions of the Carneys Point Township Code.

NATURAL STREAM
A naturally eroded channel with visible evidence of banks
and bed, as distinguished from a swale, which shows no evidence of
natural erosion, except occasional gullying, and from a ditch, which
is an artificially excavated channel.
NET METERING
A system of metering electricity in which the electric distribution
company 1) credits a customer-generator for each kilowatt-hour produced
by a Class 1 renewable energy system installed on the customer-generator's
side of the electric revenue meter, up to the total amount of electricity
used by that customer during an annualized period; and 2) compensates
the customer-generator at the end of the annualized period for any
remaining credits, at a rate equal to the supplier/provider's avoided
cost of wholesale power. Net metering is regulated pursuant to N.J.S.A.
48:3-87e.

PAD SITE
An unsubdivided portion of a shopping center which is dedicated
to a freestanding commercial use such as a restaurant, gas station,
or other such use and which is integrated into the design of the center.

PARKING SPACE, OFF-STREET
A space off the street right-of-way which, exclusive of driveways
and aisles giving access thereto, is not less than 10 feet wide and
20 feet long if an enclosed garage or not less than 8 1/2 feet
wide by 19 feet long if in the open and which is available and accessible
for the parking of a motor vehicle.
PERSONAL SERVICES SHOP
An establishment or business which provides services of a
personal nature, such as hair care, nail and skin care, tanning salons,
and other similar types of services. The term “personal services
shop” specifically excludes tattoo parlors, massage parlors
and check-cashing establishments.

PRESERVED FARMLAND
Land on which a development easement was conveyed to or retained
by the New Jersey State Agricultural Development Committee, a board,
or a qualifying tax-exempt nonprofit organization pursuant to any
state law enacted for farmland preservation purposes.

RENEWABLE ENERGY FACILITY
A system of structures and equipment that engage in the production
of electric energy from wind, solar or photovoltaic technologies.

RIGHT OF WAY LINES
The boundary lines of land used or intended for use as streets
and from which set back and other requirements shall begin. Where
existing records are vague or show a lesser dimension, they shall
be considered to be not less than 50 feet apart, 25 feet from the
center line thereof.
ROADSIDE STAND
A permanent structure, together with its surrounding display
area and supporting off street parking area, designed for the retail
sale of farm produce and located as an accessory use on the farm where
at least 25% of its products are grown. The intermittent sale of homegrown
produce as an accessory use not involving a building or structure,
not occupying more than 300 square feet and not creating any undue
traffic hazard shall not be deemed to constitute a "roadside stand."
ROTOR DIAMETER
The cross-sectional dimension of the circle swept by the
rotating blades of a wind-powered energy generator.

SELF-STORAGE FACILITY
A structure containing separate, individual, and private
storage spaces of varying sizes leased or rented on individual leases
for varying periods of time.

SHOPPING CENTER
A group of commercial establishments on one tract of land
that is planned and developed as an operating unit and where on-site
parking is provided in definite relationship to the type and total
size of the stores. The commercial establishments may be located in
one or several buildings, attached or separated. A shopping center
shall be planned as a single entity. For purposes of this definition,
the following categories of shopping centers are defined:

(1)
REGIONAL SHOPPING CENTERA shopping center containing at least one anchor of 100,000 square feet or more, such as a department store (K-Mart, WalMart, etc.), wholesale club (Costco, BJ’s, Sam’s Clubs, etc.) or warehouse retail (Home Depot, Office Max, Sports Authority, etc.), as well as two or more uses permitted in §
212-48.4B.
SIGN
Any device designed to inform or attract the attention of
persons not on the premises on which the device is located; provided,
however, that the following shall not be included in the application
of the regulations herein:
(1)
Signs not exceeding one square foot in area
if bearing only property numbers, post box numbers or names of occupants;
and two square feet if including professional office or home occupation
identifications.
(2)
Flags or insignias of any public, civic, charitable
or religious group, except when displayed in connection with commercial
promotion.
(3)
Legal notices or informational or directional
signs erected by governmental bodies.
(4)
Integral, decorative or architectural features
or buildings, except letters, trademarks, moving parts or moving lights.
(5)
Signs directing and guiding traffic and parking
on private property, but bearing no advertising matter.
(6)
Signs not exceeding four square feet in area
indicating the private nature of a driveway or other premises or otherwise
controlling the use of private property.
(7)
Traditionally holiday or season greetings or
decorations not advertising a specific product, service or establishment.
(9)
Signs advertising yard sales.
SIGN INTERPRETATION AND MEASUREMENT
(1)
For the purpose of determining the number of
signs, a "sign" shall be considered to be a single display surface
or display device containing elements organized, related and composed
to form a unit. Where matter is displayed in a random manner without
an organized relationship of elements, or where there is a reasonable
doubt about the relationship of elements, each element shall be considered
to be a single sign.
(2)
The surface area of a sign shall be computed
to include the entire area within a parallelogram, triangle, circle
or semicircle comprising all of the display area of the sign and including
all of the elements of the matter displayed. Frames and structural
members no bearing advertising matter shall not be included in computation
of the sign surface area.
SIGN, ON-SITE
A sign relating in its subject matter to the premises on
which it is located or to the products, accommodations, services or
activities on said premises. "On-site signs" do not include signs
erected by the outdoor advertising industry in the conduct of the
outdoor advertising business.
SOLAR ENERGY
The radiant energy received from the sun which through photovoltaic
technologies or other solar technologies is used to produce electricity.

SOLAR ENERGY FACILITY
A solar or photovoltaic energy system and all associated
structures and equipment which converts solar energy into electricity,
heats water, and/or produces hot air, other than solar reflective
or concentrating technology.

SOLAR PANELS
Equipment containing one or more receptive cells or other
devices mounted on arrays, rooftops or other structures and utilizing
solar or photovoltaic technologies for the conversion of solar energy
into electricity, to heat water, and/or to produce hot air.

STREET
An official public thoroughfare approved by the Township
Committee, which has been dedicated or deeded to the public for public
use or which has been offered for such dedication and which has been
or will be improved in accordance with Township standards.
STREET LINE
The right-of-way line of a street, road or other public right-of-way
used or intended for use by vehicular traffic.
STRUCTURE
Anything constructed or erected with a fixed location on
the ground, or attached to something having a fixed location on the
ground. Among other things, "structures" include buildings, walls,
fences, billboards and swimming pools. "Structures" shall not include
playground equipment, game equipment, garden structures and other
similar temporary customary yard accessories, ornaments and furniture.
SWIMMING CLUB, PUBLIC
A publicly or privately owned pool open to the public on
an annual member basis, and having dressing rooms, off street parking
and other appropriate accessory facilities.
SURFACE PARKING SOLAR ENERGY FACILITY
A ground-mounted solar energy facility located over a surface
parking area such that vehicles may park and/or drive beneath.

SWIMMING POOL, PRIVATE
A noncommercial, privately owned pool constituting an accessory
use to a residential unit or units and located on the same lot therewith.
A wading pool with a depth of less than 18 inches and portable swimming
devices located above the ground level with an area of less than 125
square feet and a water depth of less than three feet, temporary in
character and constructed of material other than concrete or masonry,
shall not be deemed "swimming pools."
TOWNHOUSE
One dwelling unit in a line of at least four but no more
than eight connected dwelling units, but is distinct by such design
features as width, setback, roof design, color, exterior materials
and other features, singularly or in combination. Each dwelling unit
may be a maximum of 2 1/2 stories in height, but nothing in the
definition shall be construed to allow one dwelling unit over another.
TRAILER
Any vehicle or similar conveyance so designed or constructed
as to permit its transportation as a fully built unit and to permit
occupancy for dwelling or sleeping purposes. Such vehicle or conveyance
may or may not rest on a permanent foundation or have permanent attachment
to the ground.
TRAILER, TRAVEL
A structure less than eight feet in width and less than 25
feet in length and not used for the purpose of day-to-day habitation
but designed to be moved from place to place, and which may be entirely
enclosed or partially enclosed with canvas or other material and which
is used for sleeping and other human occupancy during the course of
activities commonly known as "camping" or "caravanning."
TRANSIENT
A person who, as a transient guest and not as a tenant, occupies
a hotel or motel unit of accommodation temporarily and not as a dwelling
for a period of time not to exceed 30 days and only with limited travel-related
belongings.

WATERCOURSE
Any land area or use either naturally formed or artificially
designed for the storage, passage, retention or flow of water, including
but not limited to the following: lake, pond, canal, ditch, stream
or swale.
WIND ENERGY FACILITY
A wind turbine and all associated structures and equipment,
including any base, blade, foundation, nacelle, rotor, tower, transformer,
vane, wire, inverter, batteries or other component, necessary to fully
utilize the wind generator.

WIND TURBINE
Equipment that converts wind energy into electricity. This
term includes the rotor, blades and associated mechanical and electrical
conversion components necessary to generate, store and/or transfer
energy.

YARD
An open space on the same lot with the principal building,
unobstructed by buildings or structures from the ground to the sky,
except by fences, walls, poles and posts or except as otherwise provided
in this chapter.
YARD, FRONT
The yard extending across the entire width of the lot between
the street right-of-way line and the nearest part of the principal
building. In the case of lots having frontage on two streets running
generally parallel, unless the prevailing front yard pattern on adjoining
lots indicate otherwise, "front yards" shall be provided along both
street frontages. In the case of corner lots, "front yards" shall
be provided on both street frontages. Width of a "front yard" shall
be measured in such a manner that the yard established is a strip
of the minimum required by district regulations with its inner edge
parallel to the front lot line.
YARD, REAR
A yard extending across the rear of the lot between the inner
said yard lines. In the case of through lots, there will be no "rear
yards." Depth of a required "rear yard" shall be measured in such
a manner that the yard established is a strip of the minimum depth
required by district regulations with its inner edge parallel to the
rear lot line.
YARD, SIDE
A yard extending along the side lot line from the front yard
to the rear lot line. In the case of through lots, side yards shall
extend between the required front yard lines. In the case of corner
lots, two side yards shall be provided, perpendicular to the streets,
neither of which shall be less than the minimum side yard required
in the Zoning District. No rear yard will be required.
