A. No person or persons, firm or corporation shall maintain
or pursue the business or occupation of a garage, service station, stand or
any place where gasoline is sold in the Borough of Kinnelon unless such person
or persons, firm or corporation shall have first obtained a license therefor
in the manner and for the term hereinafter provided, and shall have paid to
the Clerk of said Borough a fee computed as follows:
(1) For the maintenance of a total of not more than three
gasoline pumps for one calendar year or any part thereof: $10.
(2) For the maintenance of each gasoline pump in excess of
three such pumps for one calendar year or any part thereof: $5.
B. For the purpose of determining the above fees, the term
"gasoline pump" shall be defined as a gasoline- or any other liquid fuel-dispensing
nozzle. The requirements of this chapter and the fees provided hereunder shall
be in addition to any others which may be provided by any other applicable
ordinances, laws or regulations of the Borough of Kinnelon, the County of
Morris and the State of New Jersey, or of any of the agencies thereof.

The granting of any such license shall be at the discretion of the Borough
Council, and no license shall be granted where, in the judgment of the Mayor
and Council, such place will be detrimental to the location or to the adjacent
property. Such license shall be signed by the Borough Clerk, bearing the date
of issue, the name of the person or persons, firm or corporation so licensed,
the purpose for which it is granted and the location of the garage, service
station, stand or any place where gasoline is sold wherein said business or
occupation is authorized to be carried on or conducted; and such license shall
not be transferable or valid to authorize the licensee to carry on or conduct
said business or occupation in any place or location other than that set forth
in said license; and the Borough Council may, for good and sufficient reason,
revoke any such license; provided, however, that the licensee or licensees
shall have been given or afforded an opportunity to be heard and permitted
to show cause why such action shall not be taken.
All licenses granted hereunder shall expire on the 31st day of December
of each year.

Any person, firm or corporation violating this chapter shall be subject,
upon conviction, to one or more of the following at the discretion of the
court: a fine not to exceed $1,000 or imprisonment in the county jail for
a term not to exceed 90 days or community service not to exceed 90 days and,
if licensed, shall forfeit said license.
