Guardrails will be required along the rights-of-way of roads and streets in the Borough of Kinnelon where, the opinion of the Planning Board, the Borough Engineer or the governing body, they are required for public safety.
Guardrails may be required at any time during construction or prior to final acceptance of any road as determined by the Borough Engineer or the Planning Board.
The location of the guardrail and the specifications prescribed herein shall be in accordance with the requirements set forth by the Borough Engineer.
Steel beam guardrails used shall conform to the following specifications:
A. 
Steel rail elements.
(1) 
The steel rail elements shall consist of open hearth or electric furnace steel formed into a beam not less than 12 inches wide and three inches deep in accordance with the construction details. The cross section shall consist of two corrugations symmetrical about the horizontal axis, with the rounded faces toward traffic and the edges turned away from traffic. The edges and the center of the rail shall contact each post. Splices shall be bolted and lapped not less than 12 1/2 inches.
(2) 
The steel rail elements shall be hot-dipped galvanized in accordance with ASTM specification designation A-123-53 (AASHO M-111-53). The steel rail shall develop a minimum tensile strength of 80,000 pounds for twelve-gauge rail and 100,000 pounds for ten-gauge rail. The post connections shall withstand a five-thousand-pound side pull in either direction.
B. 
Steel posts for beam guardrail shall be fabricated of structural steel to the required lengths as shown on the construction details. The steel shall be hot-dipped galvanized in accordance with ASTM specification designation A-123-53 (AASHO M-111-53).
C. 
Hardware for beam guardrail shall conform to the construction details and shall be galvanized to conform to ASTM specification A-153.
Double-height guardrail and/or posts of extra length and/or additional posts conforming to the construction details shall be used when, in the opinion of the Borough Engineer or the Planning Board, they are required for the public safety.
A. 
The steel posts shall be driven by approved mechanical devices. They shall be plumb above the ground and firm in the ground, driven to the required lines and grades. Driving shall be done only with the post head protected with an approved driving cap designed to prevent the galvanizing from separating away from the steel at the head of the post. Battered heads or damaged galvanizing shall not be permitted, and any posts which are bent or otherwise damaged to the extent that they are, in the opinion of the Engineer, unfit for use in the finished work, shall be replaced. The post spacing shall be 12 feet six inches unless additional posts are required. In the event that additional posts are required, additional holes shall be drilled in the steel rail elements for the post connections.
B. 
The rail elements and terminal pieces shall be erected to the required line and grade, and the top of the rail shall be in a straight line or shall have a smooth, continuous curve parallel and concentric to the roadway gradient. All rails shall be lapped in the direction of traffic flow. At each end post a terminal section shall be lapped on the face of the rail.
If, in the opinion of the Borough Engineer, the construction of guardrail as required by this article will infringe on Borough of Kinnelon property, a cash deposit of not less than 10% of the cost of the construction of the guardrail and the restoration of Borough properties shall be deposited with the Borough of Kinnelon in the Clerk's Special Deposit Account, to be retained for a period of one year following the completion of the installation.
This article shall be enforced by the Borough Engineer.

Any person, firm or corporation or corporation violating this article shall be subject, upon conviction, to one or more of the following at the discretion of the court: a fine not to exceed $1,000 or imprisonment in the county jail for a term not to exceed 90 days or community service not to exceed 90 days. Each day that a violation is permitted to exist shall constitute a separate offense.
