The position of Borough Administrator is hereby created. It shall be permissible for the Borough Clerk to also hold the office of Borough Administrator. In such event, the title of such dual office holder shall be Borough Administrator/Clerk.
The Borough Administrator shall be appointed on the basis of executive and administrative qualifications and training in government. Nothing herein shall prevent the Borough Administrator from also holding any other appointive municipal office of the borough and fulfilling the duties thereof.
The Borough Administrator shall be appointed by the Mayor with the advice and consent of the Council and shall serve at the pleasure of the Mayor and Council.
The compensation of the Borough Administrator shall be fixed by the Mayor and Council by ordinance.[1]

The Borough Administrator shall be the chief administrative officer of the borough, subject to the policies and directives of the Mayor and Council.
A. 
Administrative supervision and direction. For the purpose of carrying out his duties and responsibilities, within the limitations permitted by authorized staff and appropriations, the Borough Administrator shall:
(1) 
Direct and supervise the administration of all departments, divisions and offices of the borough government; approve or prescribe their internal organization; and assign and transfer administrative functions, powers and duties among and within them, subject to the approval of the Mayor and Council.
(2) 
Prescribe and enforce administrative rules to be followed by each department.
(3) 
Carry on a continuing review of departmental performance, evaluate the present level of services and make recommendations for change when indicated.
(4) 
Introduce improved methods and practices to facilitate more efficient delivery of municipal services.
B. 
Personnel and appointments. The Borough Administrator shall:
(1) 
Recommend to the Mayor and Council the appointment, promotion, demotion, suspension and removal of personnel.
(2) 
Be responsible for the maintenance and enforcement of sound and clearly stated personnel policies and practices, including the establishment and maintenance of sick leave, vacation schedules and personnel records for each employee of the borough, the development of a position classification plan and a pay plan relating pay to the duties and responsibilities of each job and the implementation of an orderly grievance procedure and the enforcement and administration of disciplinary procedures.
(3) 
Be responsible for collective bargaining on behalf of the borough in conjunction with the Borough Attorney.
C. 
Financial. The Borough Administrator shall, in consultation with the Chief Financial Officer:
(1) 
Prepare and recommend to the Council an annual budget, together with such explanatory statements as may be desirable and/or necessary. The budget shall be in such form as is required by law and shall have appended thereto detailed analyses of the various items of expenditure and revenue.
(2) 
Review programs approved in the budget to evaluate their effectiveness and to ensure that funds are spent only for purposes for which they were appropriated.
(3) 
Review borough accounting and financial reporting systems.
(4) 
Report the fiscal status of the borough to the Mayor and Council, together with the findings and recommendations resulting from all financial investigations.
(5) 
Approve and recommend to the Mayor and Council the payment of all bills and vouchers subject to preaudit and control as prescribed by law.
D. 
Contracting agent. The Borough Administrator shall be the contracting agent for the borough and shall:
(1) 
Supervise a centralized system for the purchase of supplies, materials, equipment and contractual services so as to combine where possible the requests and purchase the same in bulk quantities and so as to control the commitment of appropriations for such purposes.
(2) 
Explore the possibility of cooperative purchasing with other governmental bodies.
(3) 
Negotiate contracts for the borough, subject to the approval of the Mayor and Council.
(4) 
Make recommendations concerning the nature and location of municipal improvements and implement municipal improvements as determined by the Mayor and Council.
(5) 
Assure that all terms and conditions imposed in favor of the borough or its inhabitants by any statute, public utility franchise or other contract are faithfully kept and performed and, upon knowledge of any violation, call the same to the attention of the Mayor and Council.
(6) 
Develop a list of municipal improvements and projects to be undertaken over a period of years, in order of priority, for the consideration of the Mayor and Council.
(7) 
Execute all contracts on behalf of the borough, upon resolution of the Mayor and Council.
E. 
Public relations and public information. The Borough Administrator shall supervise borough public relations and public information, which shall include but not be limited to the following:
(1) 
Answer requests for information.
(2) 
Respond to complaints.
(3) 
Prepare a quarterly report to the citizens on municipal activities, which shall be furnished to the Mayor and Council for its review and comment prior to distribution to the public.

(4) 
Appear before civic groups to explain municipal programs.
F. 
Planning and intergovernmental cooperation. The Borough Administrator shall assist the Mayor and Council in planning and intergovernmental cooperation by:
(1) 
Recommending any federal or state grant-in-aid programs for which the borough might qualify and, with the consent of the Mayor and Council, submitting applications for such grants.
(2) 
Evaluating and reporting the possible impact on the borough of any state or federal legislation, so that the Mayor and Council can take action to support or oppose such legislation.
(3) 
Coordinating the borough's plans for development with those of the county, state and other municipalities, or regional organizations.
(4) 
Working with municipal agencies, such as but not limited to the Board of Education, Board of Health and Planning Board.
(5) 
Undertaking studies and surveys of current and long-range problems, for the information of the Mayor and Council.
G. 
Meetings of the Mayor and Council. The Borough Administrator shall:
(1) 
Supervise the preparation of the agenda for such meetings.
(2) 
Attend such meetings, with the right to participate in discussions but not to vote.
H. 
Other duties. The Borough Administrator shall:
(1) 
Perform such other duties as may be specified by the Mayor and Council.
(2) 
Devote full-time to the interests of the borough and not hold any other employment, except when approved by the Mayor and Council.
I. 
Scope of authority. Nothing in this Article shall be construed to authorize the Borough Administrator to exercise the statutory powers and duties of the elected and appointed officials of the borough.
The Borough Administrator may be removed, with or without cause, by a two-thirds vote of the Mayor and Council. The resolution of removal shall become effective three months after its adoption by the Mayor and Council, provided, however, that the Mayor and Council may provide that the resolution shall have immediate effect; provided, however, that the governing body shall cause to be paid to the Borough Administrator forthwith any unpaid balance of his salary and his salary for the next three calendar months following the adoption of the resolution.

A. 
During the extended absence by reason of illness or incapacity or in the event that the position is vacant, the Borough Clerk shall serve as Acting Borough Administrator to perform the functions of and fulfill the duties and responsibilities of the Borough Administrator during the absence of the Borough Administrator. In the absence of both the Borough Administrator and the Borough Clerk, the Chief Financial Officer shall serve as Acting Borough Administrator.
B. 
Any action taken by any Acting Borough Administrator shall have the same effect and validity as if taken by the Borough Administrator; provided, however, that the Mayor and Council may, at any time, by resolution, designate some other person to serve as Acting Borough Administrator for such time as the Mayor and Council may designate.
