No person, firm or corporation shall permit or allow the consumption
of alcoholic beverages, including wine or malt alcoholic beverages,
in any restaurant, dining room or other public place where food or
liquid refreshments are sold or served to the public or any portion
thereof unless said premises shall be duly licensed in accordance
with the Alcoholic Beverage Act of New Jersey[1] authorizing the sale of alcoholic beverages for on-premises consumption; and, unless said premises are so licensed, no wines, malt alcoholic beverages or other alcoholic beverages shall be sold, served or brought upon said premises by any patron or other person, and further, no such alcoholic beverages shall at any time be consumed upon any portion of said premises open to the public. Such license shall include the service or consumption of such beverages only upon the premises of the license holder and not within any sidewalk cafe appurtenant thereto located upon the public right of way pursuant to either § 225-1 et seq. of this Code or pursuant to § 275-21K(1) of this Code.

Notwithstanding the prohibitions contained in § 84-13 of this article, customers of the age of at least 21 years of any unlicensed restaurant or commercial dining room lawfully operated in the Central Business District of this Borough, as such district is designated on the Zoning Map, if the owner or operator of such restaurant or dining room so permits, may bring and consume thereupon wine or beer but exclusive nevertheless of any spirituous liquor, all as such beverages are more specifically defined in Title 33 of the Laws of the State of New Jersey, while dining upon such premises but only within the premises of the operator and not within any sidewalk cafe appurtenant thereto located upon the public right of way pursuant to either § 225-1 et seq. of this Code or pursuant to § 275-21K(1) of this Code.
