No person shall operate or maintain or permit the operation of or maintenance of, for public use, where an admission fee is charged, any carnival, circus, outdoor performance or play, picnic grounds, athletic field or other place of public amusement within the limits of the Borough without first having obtained a license for that purpose.
A. 
Any person desiring to obtain a license under this chapter shall make application, in writing, to the Clerk for such license, giving the name and address of the applicant and, when required, the names of all persons employed in the public amusement grounds or place, either as employees, attendants or performers. The Clerk shall immediately present such application to the Council for its consideration.
B. 
The fee for such license shall be as set forth in Chapter 134, Licenses and Permits.[1]

A. 
All licenses shall expire on the 31st day after issuance.
B. 
All licenses, when issued, may be revoked at any time by the Council upon failure of the applicant or any of his employees, attendants or performers to comply with all the laws, rules and regulations of this state, county or municipality or any of its boards or agencies having jurisdiction thereover.

The Clerk shall keep a record of all such licenses issued by him, which records shall set forth the date of the application, the date of the issuing of the license, the name and address of the applicant, the purpose for which the license is granted, the location of such amusement grounds or place and the amount of the license fee and, when required, the names of all employees, attendants and performers at such amusement ground or place.
B. 
No license shall be granted until the Council shall authorize the issuance of the same.
This chapter shall not apply to any nonprofit organization having its principal office or address within the Borough.
Violation of the provisions of this chapter shall be punishable as provided in Ch. 1, General Provisions, Art. III, General Penalty.
