A. 
Terms used in this chapter which are defined in N.J.S.A. 4:19-15.1 et seq. shall have the meanings set forth in said statute.
B. 
The following additional terms shall have the meanings indicated:
ANIMALS
Any and all types of animals, both domesticated and wild, male and female.
AT LARGE
Off the premises of the owner or custodian of the animal and not under the immediate control of the owner or custodian.
DOG
Any member of the species canis familiaris.
DOG LICENSE
A license and registration tag required to be issued annually for each individual dog.
KEEP or HARBOR
To maintain, possess, control and use.

A. 
In addition to the Animal Cruelty Laws of the State of New Jersey set forth at N.J.S.A. 4:22-17 et seq., no person shall permit, suffer or allow any dog owned or harbored by him or her within the Borough of Saddle River to continually and unreasonably bark, howl or yelp for a period of more than 20 continuous minutes between the hours of 7:00 a.m. and 10:00 p.m. or for a period of more than 15 continuous minutes between the hours of 10:00 p.m. and 7:00 a.m. Prima facie evidence of a violation of this section shall include but not be limited to:
(1) 
Vocalizing (howling, yelping, barking etc.) at an average of two vocalizations or more per minute in the applicable period.
(2) 
When two or more persons residing in different houses and within hearing distance of the dog or dogs shall complain of such vocalization.
(3) 
For the purposes of this section, "continuous" is defined as uninterrupted, unbroken, not intermittent or occasional, so persistently repeated at short intervals as to constitute virtually an unbroken series.
B. 
No dog owner shall permit his dog to trespass upon the property of any other persons in the Borough of Saddle River nor suffer or permit his dog to damage shrubbery, flowers, gardens or any other property of any kind or character belonging to any neighbor or other person in the Borough of Saddle River.
C. 
In any proceeding before the Municipal Court upon a complaint duly made and filed under this chapter, if the Court shall find that the dog in question has committed the prohibited acts alleged in the complaint, then there shall be a presumption that the defendant owner, possessor or harborer has suffered or permitted said dog to commit the prohibited acts alleged in the complaint, and it shall not be necessary that the complainant prove the defendant's knowledge, intention or scienter.
D. 
Any person found violating this section shall be fined in the discretion of the municipal court judge as follows: A first offense shall carry a fine not to exceed $100. A second offense shall carry a fine not to exceed $250. A third offense and any offense thereafter shall carry a fine not to exceed $500.

Any person owning or having in his custody animals and whose animals shall run at large beyond the boundary line of the property of such person to the injury or annoyance of others shall be guilty of a violation and subject to a penalty. Such action is declared to be a nuisance and dangerous to public health and safety.
No person shall willfully cause injury or suffering to or mistreat or abuse any animal.
No person shall keep animals in any place or in any manner which is detrimental to human health or which will create a nuisance.
A. 
The premises upon which animals are kept shall always be sanitary and subject to inspection and regulation by the Borough.
B. 
In the event that any owner, occupant or tenant of such premises forbids the entry of any representative of the Borough, then a warrant shall issue according to law at the request of such representative.
No person shall abandon or set loose with the intention of avoiding the responsibility for the custody and care of any animal within the limits of the Borough.
A. 
Any person operating a motor vehicle who knowingly hits, runs over or causes injury to any animal shall stop at once, ascertain the extent of the injury and report to the nearest police station, police officer or the pound.
B. 
The motorist shall report his name, address, operator's license and registration number and the location of the injured animal.
A. 
No person shall at any time set or use a trap of any kind designed or intended to take, hold, capture or kill any bird or animal within the limits of the Borough, except as specifically permitted by this Code.
B. 
In order to protect property or health, the owner or tenant of any property within the Borough may trap birds or animals within any building located on the property of which he is the owner or tenant by any means or may trap any bird or animal by means of a cage-type trap, commonly called a "cage trap," "cage door trap" or "live trap," designed to capture animals alive.
C. 
Whenever a trap, the use of which is prohibited by this Code, shall be found within the confines of the Borough, it may be confiscated by any police officer of the Borough or by any New Jersey Fish and Game Warden.
