This article shall be a local law authorizing the Town of Stony Point to supersede Town Law § 27 by allowing the Town Attorney to be compensated on an hourly rate limited to a fixed amount to defend the Town of Stony Point against tax certiorari and small tax claims. This article authorizes the Supervisor of the Town of Stony Point to set aside funds in the budget of the Town Assessor limited to $5,000 per calendar year to enable the town to defend against tax certiorari and small tax claims which have become prevalent in the Town of Stony Point upon the advent of solicitation by certain tax claim services. The Town Board must approve of such compensation upon its review of the Town Attorney's itemized bill for services.
This article shall be known as "Town Attorney, Defense of Tax Certiorari and Small Tax Claims."
The Town Board of the Town of Stony Point hereby authorizes the Town Attorney to be compensated on an hourly rate limited to a fixed amount to defend the Town of Stony Point against tax certiorari and small tax claims.
The Town Attorney shall receive compensation in addition to salary for the defense of tax certiorari and small tax claims. Such compensation shall be funded out of the budget of the Town Assessor. The compensation must be approved by the Town Board upon its review of the Town Attorney's itemized bill and shall be limited to $5,000 per calendar year.
