A. Board of Recreation Commissioners. A Board of Recreation
Commissioners for the Borough of Netcong is hereby established, the members
of which shall be appointed by the Mayor. Said Board shall consist of seven
members. The Commissioners first appointed shall serve the following terms:
one member for a term of one year; one member for a term of two years; two
members for terms of three years; two members for terms of four years; and
one member for a term of five years. Thereafter, all appointments shall be
for terms of five years, and vacancies shall be filled for the unexpired term
only. Members shall serve until their respective successors are appointed
and shall qualify. Members shall receive no compensation for their services.
B. Alternate members. There shall be two alternate members
of the Board of Recreation Commissioners appointed by the Mayor, who shall
be designated at the time of their appointments "Alternate No. 1" and "Alternate
No. 2." The terms of the alternate members shall be for five years, except
that of those first appointed, Alternate No. 1 shall hold office for five
years and Alternate No. 2 shall hold office for four years. The alternate
members may participate in discussions of the Commissioners, but may not vote
except in the absence or disqualification of a regular member. In the event
that a choice must be made as to which alternate member is to vote, Alternate
No. 1 shall vote.
One member of the Board of Recreation Commissioners shall be a member
of the Borough Council and shall serve as Council liaison to the Commission.
The Board of Recreation Commissioners shall meet one day a month, said
regular meeting date to be determined at the annual organization meeting.
The governing body shall annually fix, determine and appropriate a sum
sufficient for the support of recreation programs under the jurisdiction of
the Board of Recreation Commissioners and for the expenses of the Board, which
shall be raised by taxation in the same manner as other taxes.
The powers and duties of the Board of Recreation Commissioners shall
be as established by N.J.S.A. 40:12-1 et seq. The functions and activities
of the Board of Recreation Commissioners shall be under the general supervision
of the Mayor and Borough Council. The Board shall provide the Mayor and Borough
Council with a monthly report of all charges and fees collected by the Board
and all expenses incurred and expenditures made, as well as a summary of all
activities of the Board and services rendered by it.
The use of all recreational facilities shall be under the control of
the Borough Council of the Borough of Netcong.
All persons using any of the recreational facilities of said Borough
of Netcong shall be required, on demand of any peace officer or recreation
personnel then in charge of said facility, to furnish proof of identity.
Any person violating any of the provisions of this chapter shall be
subject to a penalty of not more than $100 or to imprisonment for not exceeding
10 days, or to both such fine and imprisonment, in the discretion of the Judge
of the Municipal Court, and, further, any such person so violating any of
the provisions of this chapter may be summarily evicted from any recreational
facility in the Borough of Netcong in the County of Morris.
