The purpose of this ordinance is for the Township to provide death benefits to firemen who are not eligible for death benefits under the Constitution and Bylaws of the New Jersey State Firemen's Association and the General Relief Fund Rules promulgated thereunder for the sole reason that they were confirmed as firemen at an age higher than that permitted by said constitution, bylaws and rules. Persons entitled to death benefits under the Constitution and Bylaws of the New Jersey State Firemen's Association and the General Relief Fund Rules promulgated thereunder are not entitled to benefits under this article.
A fireman who would have been entitled to death benefits under the Constitution and Bylaws of the New Jersey State Firemen's Association and the General Relief Fund Rules promulgated thereunder but for the requirement therein that the fireman be less than a certain age at the time of his confirmation shall, upon his or her death, be eligible to be paid by the Township of River Vale a sum equal to the benefits that would have been paid by the New Jersey State Firemen's Association to the fireman had he or she been eligible for death benefits in accordance with said constitution, bylaws and rules. Payment of death benefits shall be made to the estate of the deceased fireman upon the Fire Chief's certifying to the Township Council that the fireman is eligible for benefits in accordance with this article.
