The purpose of this chapter is to establish a yard waste collection and disposal program in the Township of Wyckoff, so as to protect public health, safety and welfare, and to prescribe penalties for the failure to comply.
A. 
For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use the text of this chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
B. 
As used in this chapter, the following terms shall have the meanings indicated:
CONTAINERIZED
The placement of yard waste in a trash can, bucket, paper or plastic bag, or other vessel excluding landscaper barrels or metal or plastic drums not to exceed 50 pounds, such as to prevent the yard waste from spilling or blowing out into the street and coming into contact with the stormwater.
PERSON
Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive, or other way, which is an existing state, County or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.
YARD WASTE
Leaves, grass clippings, and branches.

A. 
Leaves. During the Wyckoff leaf collection periods, sweeping, raking, blowing or otherwise accumulating leaves for collection that are not containerized at the curb shall not be placed in the paved portion of the roadway nor closer than 10 feet to any storm drain inlet but may be placed in the grass portion of the unpaved right-of-way. If such placement of leaves occurs within 10 feet of any storm drain inlet or in the roadway, the property owner shall be responsible for the prompt removal of leaves from the street or from any drain inlet encroachment, or said property owner shall be deemed in violation of this chapter.
B. 
[1]Branches. Branches shall only be tied in three-foot lengths or containerized and placed at the curb no sooner than 6:00 p.m. of the night preceding the scheduled and announced collection. They shall also not be placed closer than 10 feet from any storm inlet. Placement of branches at the curb or along the street at any other time or in any other manner is a violation of this chapter. If such placement of branches occurs, the property owner shall be responsible for the prompt removal of branches from the street, or such property owner shall be deemed in violation of this chapter.

The provisions of this chapter shall be enforced by the Wyckoff Police Department, the Township Engineer, the Public Works Manager or other Code Officials of the Township of Wyckoff or contracted by the Township of Wyckoff.

Any person(s) who is (are) found to be in violation of the provisions of this chapter shall be subject to a fine of $100 for the first offense and up to $2,000 for a second and each subsequent offense.
Each section, subsection, sentence, clause and phrase of this chapter is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or holding of any such portion of this chapter to be unconstitutional, void or ineffective for any cause, or reason, shall not affect any other portion of this chapter.
