No person or persons shall destroy or injure in any way or tamper with
or deface any public property in the Borough of Monaca or any grass, walk,
tree, lamp, ornamental work, building, streetlight, public accommodation of
any kind or nature, fire hydrant or water or gas stop box on or in any of
the streets, alleys, sidewalks, public grounds or public buildings in the
Borough.
No person or persons shall, in any manner, interfere with or meddle
with or pull, drive, change, alter or destroy any stake, post, monument or
other evidence of any elevation, grade line, location, corner or angle in
the Borough of Monaca made, placed or set or hereafter made, placed or set
or caused to be done by the authorities of the Borough or by any licensed
surveyor or engineer in any survey of or in any street, alley or public ground
in the Borough to evidence the location, elevation, line, grade, corner or
angle of any public street, alley, sidewalk, curb, gutter, sewer, drain or
other public work, matter or thing.
No person or persons shall willfully or maliciously destroy or remove
or deface or obliterate or cover up any lamp, warning sign, flare or barricade
erected by the authorities of the Borough or by any person, firm or corporation
doing work by permission of the authorities of the Borough on any of the streets,
alleys, sidewalks, bridges or public grounds in the Borough.
No person or persons shall take any earth, stone or other material from
any of the streets, alleys, parks or other public grounds in the Borough of
Monaca.
This article shall not apply to normal activities in connection with
the construction, maintenance and repair of streets, alleys, sidewalks and
public grounds and the structures and fixtures thereon or therein or to incidental
results of work done thereon or therein upon permit from or by authority of
the Borough.

The following words, as used in this article, shall have the meanings
ascribed to them:
A person appointed guardian or given custody of a minor by a Circuit
Court of the commonwealth, but does not include a person appointed guardian
or given custody by a Juvenile Court.
A person who is above the age of 11 years but not yet 19 years of
age.
It shall be unlawful for any person to willfully, maliciously or negligently
break, deface, injure, remove or destroy any property within the Borough of
Monaca, whether said property is owned by the state, county, Borough, any
other governmental body or by any private person or to condone such actions.
The parent or legal guardian of an unemancipated minor residing with such parent or legal guardian shall be presumed, in absence of evidence to the contrary, to have failed to exercise adequate parental responsibility, and said minor shall be deemed to have committed the acts described in § 219-8 above with the knowledge and permission of the parent or guardian, and the parent or guardian shall be deemed to be in violation of the provisions of this article upon the occurrence of the following:
A.
An unemancipated minor residing with said parent or legal
guardian shall either be adjudicated to be in violation of this article or
any other ordinance, law or statute prohibiting willfully and malicious acts
causing injury to a person or property or shall have incurred nonjudicial
sanctions from another official agency resulting from an admission of guilt
of violation of the aforementioned;
B.
Said parent or legal guardian shall have received official
written notice thereof, by certified or registered mail, return receipt requested,
or by personal messenger, with certificate of messenger service returned,
from the Monaca Police Department, following said adjudication or nonjudicial
sanction; and
C.
If at any time within one year following receipt of the official notice set forth in Subsection B above, said minor is either adjudicated to be in violation of this article or any other article, law or statute as described in Subsection A above or shall have incurred nonjudicial sanctions from another official agency resulting from an admission of guilt of violation of this article, law or statute as described in Subsection A above.
