No person, firm or association shall engage
in the business of selling or storing trees commonly known and used
as "Christmas trees" unless he obtains a permit therefor from the
Mayor of the City, which permit shall be granted upon application
setting forth the following facts:
A. The location of the proposed business or storage facility.
B. The area of the premises to be devoted to the use
or uses herein described.
C. The name and address of the owner of the premises
to be used for the purposes herein described.
D. The name and address of the person, firm or association
conducting the business herein described.
Such applicant shall certify
to the aforesaid facts as being true under the penalty of perjury.

Said permit shall contain the following statements:
A. The applicant agrees not to display any Christmas
trees between the sidewalk and curb or to place them there at any
time before or after the expiration of his permit; and further,
B. Agrees to remove all Christmas trees from the aforesaid
premises at his own expense and at no expense to the city.
C. Agrees to provide off-street parking for one vehicle
for every 500 square feet of display area. Where the licensed premises
abut on a curbed street, the licensee shall provide temporary ramps
necessary to cross over such curbs to the parking area. Such temporary
ramps shall be removed from the street at the close of operation each
day.

No permit shall be issued pursuant hereto prior
to the first day of November of any calendar year, and any permit
so issued shall expire on the fifth day of January next succeeding
its issuance.
Any person, firm or association violating the
provisions of this ordinance shall be liable to a fine or penalty,
not to exceed $500.
This ordinance shall take effect immediately.
