The Town Board of the Town of Maine hereby determines
that the power to equip, operate and maintain playgrounds and recreation
centers in the Town of Maine shall be exercised by a recreation commission.
Pursuant to and in accordance with the provisions
of § 243 of the General Municipal Law, the Town Board of
the Town of Maine hereby establishes a Town of Maine Recreation Commission
(hereinafter referred to as "Commission") which shall possess all
the powers and be subject to all the responsibilities of local authorities
under Article 13 of the General Municipal Law.

The Commission shall consist of seven persons
who are residents of the Town of Maine, to be appointed by the Town
Board of the Town of Maine, to serve for terms as set forth herein
or until their successors are appointed. The members of the Commission
first appointed shall be appointed for such terms that the term of
one Commissioner shall expire annually thereafter, and their successors
shall thereafter be appointed to serve terms of four years.

Members of the Commission shall serve without
pay. Vacancies in the Commission occurring otherwise than by expiration
of term shall be for the unexpired term and shall be filled following
an official vacancy posting at the Town Hall and on the Town website.
All candidates shall complete an application for the position, with
references, and shall be subject to a background check by the Broome
County Sheriff’s Office. The Commission members shall review
and assess candidates, conduct interviews, and may recommend, by majority
vote of the Commission, the appointment of a candidate by the Town
Board. At all times, the Town Board shall have sole discretion to
appoint members of the Recreation Commission.
Pursuant to and in accordance with the provisions
of § 95 of the General Municipal Law, the Town Board of
the Town of Maine hereby establishes the Commission as a Town of Maine
bureau and agency for the purpose of coordinating and supplementing
the activities of public and private agencies devoted in whole or
in part to the welfare and protection of youth in the Town of Maine,
and to undertake and promote activities and establish, maintain and
operate projects devoted in whole or in part to providing leisure-time
activities for youth or assistance to children. Said Commission shall
be maintained and operated for said purpose.

This article is adopted pursuant to the authority
of Chapter 365 of the Laws of 1976 which added a new subparagraph
(3) to paragraph d of subdivision 1 of § 10 of the Municipal
Home Rule Law authorizing towns to adopt a local law to amend or supersede
any provision of the Town Law in relation to the property, affairs
or government of the Town or in relation to any of the other enumerated
subject matters in such § 10, unless there is a state legislative
restriction on such amendment or supersession.
The second sentence of subdivision 1-a of § 64
of the Town Law of the State of New York is hereby superseded and
amended in its application to the Town of Maine so that said sentence
shall hereafter read and provide as follows: The amount of the petty
cash fund established for a receiver of taxes and assessments in a
Town of the first class shall not exceed $1,000; the amount of the
petty cash fund established for the Supervisor of the Town of Maine,
Deputy Supervisor of the Town of Maine and Bookkeeper of the Town
of Maine for the implementation of the Town of Maine Prescription
Reimbursement Plan shall not exceed $1,000; the amount of the petty
cash fund established for the Town of Maine Recreation Commission
shall not exceed $500; and the amount of the petty cash fund established
for any other Town of Maine officer or office or department head shall
not exceed $200.
Pursuant to and in accordance with the provisions
of subdivision 1-a of § 64 of the Town Law (as superseded
and amended by this article), the Town Board hereby establishes and
creates a petty cash fund (hereinafter "fund") in the amount of $500
for the Town of Maine Recreation Commission (hereinafter "Recreation
Commission"), for the payment, in advance of audit of properly itemized
and verified or certified bills for materials, supplies or services
furnished to the Town Recreation Commission for the conduct of its
affairs and upon terms calling for payment to the vendor upon delivery
of any such materials or supplies or the rendering of any such services,
provided that moneys in the fund also may be used for the purpose
of making change when such is required in the performance of Recreation
Commission activities. At the time of any payment from the fund, the
Chairperson, Secretary or other officer of the Recreation Commission
shall require delivery to him or her of a bill in form sufficient
for audit by the Town Board as required by law. At each meeting of
the Town Board a list of all expenditures made from the fund since
the last meeting of the Town Board, together with the bills supporting
such expenditures, shall be presented to the Town Board for audit,
and the Town Board shall direct the Supervisor of the Town to reimburse
the fund from the appropriate budgetary item or items in an amount
equal to the totals of such bills which the Town Board shall so audit
and allow. Any of such bills or any portion of any of such bills which
the Town Board shall refuse to audit and allow shall be the personal
responsibility of the Recreation Commission Chairperson, Secretary
or other officer who authorized such expenditure, and he or she shall
promptly reimburse the fund in the amount of such disallowances. Any
bond or undertaking filed by the Chairperson, Secretary or other officer
of the Recreation Commission shall be available to the Town for recovery
of any losses incurred by reason of the operation of the fund.
