The Town Board recognizes that:
A. On June 7, 2006, § 27-b of the Labor Law
(hereinafter "Labor Law") of the State of New York was enacted, and
it became effective on March 4, 2007;
B. Job-related homicides are the third leading cause
of death for all workers and this, in turn, results in lost workdays,
lost wages, lost productivity, legal expense, property damage, damaged
public image and increased security costs;
C. "Workplace violence" is defined in the Labor Law as
any physical assault, threatening behavior, or verbal abuse occurring
in the work setting; and
D. Many of the provisions of § 27-b of the
Labor Law apply only if an employer has 20 or more full-time permanent
employees and, accordingly, since the Town has less than 20 full-time
permanent employees, many of the provisions of § 27-b of
the Labor Law do not apply to the Town.
To the extent that § 27-b of the Labor
Law, or the important public policy implications and objectives of
that law, may apply to the Town, the Town shall make reasonable efforts
to undertake an assessment of workplace violence in the Town; develop
and implement a workplace violence prevention plan; conduct training
programs for Town employees; advise Town employees of workplace violence
risks and issues; encourage Town employees to consult with their department
heads if they become aware of any workplace violence or the potential
therefor; develop a reporting and recordkeeping system relating to
workplace violence; and take other reasonable steps to minimize the
possibility that there may be workplace violence in the Town.
The Town Clerk of the Town is hereby directed
to post a certified copy of this chapter on the Town Clerk's signboard;
and the Highway Superintendent of the Town is hereby directed to post
a certified copy of this chapter on the bulletin board within the
Town Highway Department Garage.
