This chapter shall be known as "Regulating the
Use of Tents and Awnings."
It is the purpose of this chapter to regulate
the use of tents and awnings for the assembly of people, displaying
of wares or for any other purpose and prohibiting the use of any property
or other premises for the aforesaid purposes which do not comply with
such regulations.

No person, firm or corporation shall erect or
install a tent or awning covering an area greater than 120 square
feet without obtaining a permit therefor.
The application for each permit shall be in
writing and signed by the owner or occupant of the premises. It shall
state:
A. The name and address of the applicant.
B. The name and address of each owner of the premises.
C. A description of the premises sufficient to readily
identify the same.
D. A statement setting forth the type of proposed structure
to be erected, tent or awning, the size, the location on the property,
the use to which it is to be put and the number of people expected
to visit the premises.
E. Proof that the material used for the tent or awning
is flameproof.
F. The length of time said awning or tent is to remain
on said premises.
All tents and awnings erected on any premises
shall be subject to the following regulations:
A. The design, construction, flameproofing, location, maintenance
and use of tents and awnings shall be approved by the Fire Marshal
of the Town of Gates by written consent thereof.

Upon approval of the Fire Marshal and the filing
of prerequisites, the Fire Marshal shall issue a permit; any permit
so issued shall be effective from and after the date of issuance and
shall expire two weeks thereafter. All permits shall expire on the
expiration date thereof unless, for good cause shown, the time is
extended by the Fire Marshal.

Before the issuance of a permit the applicant
shall pay the Town Clerk a fee as set from time to time by resolution
of the Town Board.

Any person, firm or corporation who violates
any provision of this chapter shall be guilty of a violation and subject
to a fine of not more than $250 or to imprisonment of not more than
15 days, or both such fine and imprisonment; and, in addition, the
violation of this chapter or any of the provisions thereof shall subject
the person, firm or corporation violating the same to a civil penalty
in the sum of $50 to be recovered by the Town of Gates in a civil
action. When a violation of this chapter or any of the provisions
thereof is continuous, each 24 hours thereof shall constitute a separate,
distinct and additional violation.
