Water and sewer design standards — See Ch. A146, § A146-18.
Where a public sanitary or combined sewer is not available under the provisions of any local, county, state or federal law, the building shall be connected to a private sewage disposal system complying with the provisions of this chapter.
Before commencement of construction of a private sewage disposal system or an addition thereto, the owner shall first obtain a written permit signed by the village's Code Enforcement Officer. The application for such permit shall be made on a form furnished by the village, which the applicant shall supplement by any plans, specifications and other information as are deemed necessary by the Superintendent. A permit and inspection fee as set forth in the Village Fee Schedule shall be paid to the village at the time the application is filed; for an addition to an existing system, the permit and inspection fee shall also be as set forth in the Village Fee Schedule.[2] The foregoing rates are minimums, and any additional costs will be borne by the property owner.

A. 
A permit for a private sewage disposal system shall not be granted nor shall the same become effective until the installation is completed to the satisfaction of the Code Enforcement Officer. Plans for the design of the subsurface sewage disposal system must be designed and sealed by a New York State licensed professional engineer and must be submitted along with the permit application.
B. 
Thereafter, the Code Enforcement Officer shall submit the same to the Village Engineer, who shall be responsible for reviewing all plans and shall make a recommendation concerning the granting of the permit to the Code Enforcement Officer for all existing lots. Where the permit request is for lots contained in a proposed subdivision, site plan development, special use permit or any other proposed use which requires the approval of the Village Planning Board, the Village Engineer's recommendation shall also be forwarded to the Village of Harriman Planning Board.
C. 
Prior to the issuance of the permit, the Village Engineer shall witness two soils tests in the location of the proposed field for each system.
D. 
In addition, the Code Enforcement Officer and/or the Village Engineer shall be allowed to inspect the work at any stage of construction, and in any event, the applicant for the permit shall notify the Code Enforcement Officer when the work is ready for final inspection and before any underground portions are covered. The inspection shall be made after the receipt of the notice by the Code Enforcement Officer.
E. 
The applicant's engineer shall submit to the Code Enforcement Officer a letter of certification regarding the completion of the sewage disposal system in accordance with the approved plans and an as-built plan of the system prior to the issuance of a certificate of compliance/occupancy.
A. 
The type, capacities, location and layout of a private sewage disposal system shall comply with all regulations of the Department of Health of the State of New York, including New York State Department of Health Part 75, Standards for Individual Sewage Treatment systems, as well as New York State Department of Environmental Conservation Design Standards for Wastewater Treatment Works.
B. 
No septic tank or cesspool shall be permitted to discharge to any natural outlet. No permit shall be issued for any private sewage disposal system employing subsurface soil absorption facilities where the area of the lot is less than 20,000 square feet.
A. 
In cases of residential or commercial subdivision, a public sewer main and associated improvements shall be bonded and installed to service the subdivision. The system shall remain dry until such time that sewer capacity becomes available. At that time, the individual disposal systems shall be abandoned and connection shall be provided to the dry sewer system.
B. 
A security bond of $750 shall be provided for each residential lot and a bond of $1,500 for each commercial lot to guarantee the reconnection. The security bond shall be returned to each lot owner upon the inspection and completion of the public sewer connection.
C. 
In cases of existing individual lots utilizing private on-site sewage disposal systems, the security bond shall be required if the Village Engineer determines that the subject parcel is reasonably accessible to a public sewer system.
D. 
In the event that the owner, within a six-month period upon notification by the village, fails to make the required connection, the owner shall understand that the village shall use the security bond to pay for the sewer connection as required.
E. 
Upon abandoning the system, the septic tank shall be pumped and completely filled with clean bank-run gravel, and the line from the dwelling to the septic tank shall be removed. The cost for this work is included in the security bond.
The owner shall operate and maintain the private sewage disposal facilities in a sanitary manner at all times, at no expense to the village.
No statement contained in this chapter shall be construed to interfere with any additional requirements that may be imposed by the Health Officer.
In cases where the applicant proposes a sewage disposal system other than the conventional on-site subsurface disposal system as defined in the New York State Part 75 regulations, the applicant shall be required to obtain Orange County Department of Health approval, in addition to the Village Engineer's review, prior to further consideration by the Village of Harriman.
