In order to establish a more harmonious and cooperative relationship
between the village government and complainants alleging handicapped discrimination,
it is hereby declared that the settlement of certain differences between persons
complaining of handicapped discrimination and the village government will
be settled through the following procedures under which such complainants
may present grievances, free from coercion, interference, restraint, discrimination
or reprisal. The provisions of this procedure shall be liberally construed
for the accomplishment of this purpose.
As used herein, the following terms shall have the following meanings:
GRIEVANCE
Any claimed violation, misinterpretation or inequitable application
of Department of Treasury Office of Revenue Sharing rules, procedures and
regulations as contained in Office of Revenue Sharing regulation, 31 CFR Part
51, relating to financial assistance to state and local governments and discrimination
on the basis of handicapped and any other complaints alleging handicapped
discrimination.
HANDICAPPED INDIVIDUAL
Any person who has a physical or mental impairment that substantially
limits one or more major life activities, has a record of such an impairment
or is regarded as having such an impairment.
Every handicapped individual shall have the right to present his or
her grievance to the government in accordance with the provisions set forth
herein, free from interference, coercion, restraint, discrimination or reprisal.
The time limitations for presentation and resolution of grievances,
as hereinbefore fixed, may be waived and extended by mutual agreement of the
parties involved.
