The requirements of this chapter shall apply
to any and all public parks and recreation areas in Carneys Point
Township. Said public parks and recreation areas shall include Dunn's
Park, the Carneys Point Recreation Facility and such other areas as
are designated public parks and/or recreation areas by resolution
of the Carneys Point Township Committee. The requirements of this
chapter shall also apply to the bulkhead area along the Delaware River
on property designated as Block 20, Lot 3.01.
It shall be unlawful for any person, firm or
corporation using a public park and recreation area to:
A. Willfully mark, deface, disfigure, injure, tamper
with, displace or remove any building, table, bench, fireplace, railing,
paving or paving material, water lines or other public utilities or
parts or appurtenances thereof, signs, notices or placards, whether
temporary or permanent, monuments or other structures, equipment or
facility or park property or appurtenances whatsoever, either real
or personal.
B. Throw, discharge or otherwise place or cause to be
placed in the waters of any fountain in or adjacent to the park any
substance, matter or thing, liquid or solid, which will or may result
in the pollution of said waters.
C. Bring in or dump, deposit or leave any bottles, broken
glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or
refuse or other trash. No such refuse or trash shall be placed in
any waters in or contiguous to the park and recreation areas or left
anywhere on the grounds thereof but shall be placed in the proper
receptacles where these are provided. When receptacles are not provided,
all such rubbish waste shall be carried away from the park by the
person responsible for its presence and properly disposed of elsewhere.
D. Disturb the peace or use any profane, obscene or blasphemous
language.
E. Endanger the safety of any person by any conduct or
act.
F. Commit any assault or battery or engage in any fighting.
G. Carry, possess or drink any alcoholic beverage of
any kind whatsoever in the park and recreation area.
H. Swim, bathe or wade in any fountain or water.
I. Hunt, pursue, shoot, harm, trap or any animal or wildlife
found upon such lands.
J. Violate any rule approved by the Carneys Point Township
Committee pertaining to the use of a public park or recreation area.

Except as provided in §
147-2.2 hereof, it shall be unlawful to drive, park, use or be in possession of any vehicle in Dunn's Park, the Carneys Point Recreation Complex and on any property owned by the Township of Carneys Point, except as otherwise designated or permitted by the Township of Carneys Point. For the purposes of this section, "vehicle" shall mean every device in, upon or by which a person is or may be transported and shall include, but not be limited to, the following: automobiles, trucks, motorcycles, tractors, buses, bicycles, motorized bicycles, trailers, scooters, roller skates, in-line roller skates and skateboards.

The prohibitions of §
147-2.1 shall not apply to strollers, carriages and chairs which are exclusively and actually used to transport infants and handicapped persons. In addition, the provisions of §
147-2.1 shall not apply to the employees and agents of Carneys Point Township and the Carneys Point Township Fire Department and Rescue Squad during the performance of their official duties.

Whenever any person, group, association or organization desires to use a park, recreation area or facility owned by Carneys Point Township, said person, group, association or organization shall first obtain a permit from the Township Committee of Carneys Point Township. An application for a permit under this section shall be submitted on a form approved by the Carneys Point Township Clerk. An application for a permit under this section shall be delivered to the Carneys Point Township Clerk not less than 30 days in advance of the date for which the permit is sought. The applicant shall also deliver at that time proof of liability coverage and any fees due pursuant to §
147-4.1 hereof.

A. In connection with the issuance of a permit pursuant to §
147-4 of the Carneys Point Township Code, fees shall be assessed as follows:
(1)
Organized league use of athletic facilities (including, but
not limited to, Little League, Babe Ruth League, Twins Football and
Carneys Point-Penns Grove-Pedricktown Soccer):
(a)
Twenty dollars per registered participant, provided that said
participant is less than 18 years of age.
(b)
Thirty-five dollars per registered participant if said participant
is 18 years of age or older.
(c)
Not later than the commencement of league play, the President
of the organization shall certify, under oath, the number of participants
registered to play in the league during that season. The number certified
by the league president shall be the basis utilized for calculating
the fee due to Carneys Point Township. Said fee shall be paid to the
Township in full at the time said certification is delivered to the
Carneys Point Township Clerk.
(2)
Tournament use: $500 per tournament, provided that the tournament
does not exceed four days. If the tournament exceeds four days, the
applicant shall pay an additional fee of $100 per day for each day
over four days.

B. In the event that any use of a park, recreation area or facility exceeds four hours, an additional charge of $50 per hour shall be assessed. The fee required pursuant to this subsection shall be paid by check or money order at the time the application required pursuant to §
147-4 hereof is submitted. All fees and applications are to be delivered to the Carneys Point Township Clerk not less than 30 days in advance of the date for which the permit is sought.
C. There shall be a concession equipment replacement and maintenance
fee of $2,500 to be paid by the concession auxiliary for use of the
concession facilities. The fee shall be paid by May 15. The fee shall
be collected by the Township and deposited in the recreation trust.
Public parks and recreation areas shall not
be used for political campaigns or the posting of political signs
without the express advance written approval of the Carneys Point
Township Committee.
It shall be unlawful for any person to vend,
sell, peddle or offer for sale any commodity or article within a park
and recreation area without first obtaining a permit from the Township.
Any person, firm or corporation violating or
failing to comply with any of the provisions of this chapter shall,
upon conviction, be subject to the payment of a fine not exceeding
$1,000 or imprisonment in the Salem County Correctional Facility for
a term not exceeding 90 days, or both.
