The dumping of ashes, dirt, garbage or other refuse into the
brook running from Perlee's Hill in a southerly direction through
the Borough of Raritan, westerly of Gaston Avenue and emptying into
the Raritan River, is hereby declared to be nuisance.
Any person or persons who shall dump ashes, dirt, garbage or
other refuse into the said brook shall be liable to the penalty of
a fine of not less than $1 and not more than $20, together with the
costs of prosecution, at the discretion of the Municipal Court Judge
who shall impose the penalty. Every offender who shall refuse to pay
the fine and costs imposed hereunder may be imprisoned in the county
jail for such term as the Municipal Court Judge may determine, not
exceeding 10 days.
