In accordance with N.J.S.A. 40A:14-68, Relief Hose Company No.
2 is hereby designated as the official protective fire service agency
for the Borough of Raritan.
Relief Hose Company No. 2 shall utilize its personnel, equipment,
training, and resources to provide fire protection and other related
emergency and public services to the people and properties in the
Borough of Raritan. Relief Hose Company No. 2 shall abide by the terms
of mutual aid agreements which have been approved by Raritan.
Relief Hose Company No. 2 through its officers and members shall
have jurisdiction over the control, fighting and extinguishment of
any fire occurring within Raritan and shall have such other powers
and duties as may be required to ensure adequate fire protection in
Raritan.
Membership in Relief Hose Company No. 2 shall be in accordance
with the current Charter and Bylaws of Relief Hose Company No. 2,
both of which shall be filed with the Municipal Clerk. Relief Hose
Company No. 2 shall comply with applicable federal and state laws
and regulations prohibiting discrimination.
The officers of Relief Hose Company No. 2 shall consist of a Chief and such other line officers as deemed necessary by Relief Hose Company No. 2. The appointment of the Chief shall be made pursuant to the procedure set forth in the bylaws of Relief Hose Company No. 2. The Chief, or the Incident Commander acting in the absence of the Chief, is authorized to control and supervise the Company in the execution of its duties as described in §
21-2.
Raritan owns the fire station located at 16 Anderson Street,
Raritan, and all apparatus and equipment purchased by Raritan for
the use of Relief Hose Company No. 2. Relief Hose Company No. 2 owns
its fire station at 611 North Thompson Street, Raritan, and all equipment
purchased by it.
Raritan shall continue to provide from time to time such equipment,
supplies, apparatus and vehicles for the use of Relief Hose Company
No. 2 as the Borough Council deems necessary and for which budget
appropriations are available. Raritan shall retain title to any equipment,
supplies, apparatus and vehicles purchased with Borough funds.
The members of Relief Hose Company No. 2, in performing public
fire duty, shall be deemed to be exercising a governmental function.
Nothing herein shall be construed to increase any liability
on the part of Relief Hose Company No. 2 or its members to the public
for errors or omissions in the performance or nonperformance of duties
hereunder or pursuant to any other requirement.
Relief Hose Company No. 2 and each member shall comply with
all applicable federal and state, county and local guidelines, rules
and regulations governing firefighting and the deployment of personnel
and equipment.
