The bridle paths dedicated as part of Michiana Shores Subdivision No. 7 of the Village of Michiana shall be used only for horseback riding and pedestrian traffic and for no other purpose.
The riding of horses shall be permitted within the public street rights-of-way of the Village of Michiana pursuant to the regulations of this chapter.
The riding or driving of horses in the Village of Michiana shall be subject to the following regulations and restrictions:
A. 
No person shall ride a horse within the corporate limits of the Village of Michiana who is under 14 years of age, unless under the supervision of an adult.
B. 
Horses in the Village of Michiana shall carry no more than two persons at any one time.
C. 
No person shall ride any horse on any Village beaches.
D. 
No person shall ride any horse on private property without the express permission of the owner of said property.
E. 
Horses ridden or driven in the Village of Michiana shall travel at the extreme right of the street, with the flow of traffic, or at a rate of speed no greater than reasonable and proper to maintain control of the animal.
F. 
The owner or person in charge of any horse ridden or driven in the Village shall immediately remove any animal waste or feces discharged or deposited by such animal on private property or upon public land, bridle paths, parks, roads or other public areas. The failure to remove said waste or feces is declared to be a public nuisance.
G. 
Horses ridden or driven in the Village of Michiana must come to a complete stop at every street intersection, regardless of whether or not it is a stop street.
H. 
No horses may be ridden or driven within the Village of Michiana at any time between the hours of 9:00 p.m. and 9:00 a.m. Eastern time.
Any commercial stable or other entity that rents or provides horses for hire to be ridden on the streets or bridle paths of the Village shall, at its expense, maintain comprehensive general liability insurance (including property damage) with respect to the ownership, maintenance, use and operation of a riding stable. Such insurance shall at all times have limits of not less than $100,000 combined single limit per occurrence for bodily injury, personal injury and property damage liability as the Village Council or its insurance consultant believes are necessary to protect the Village. The amount of such insurance shall not limit the stable's liability nor relieve any stable of any obligation under this chapter. Each policy shall contain cross-liability endorsements, if applicable, and shall insure performance.
Horses may be ridden or driven on a Village street during a period of emergency, when so declared by the Village President, when travel by conventional automotive equipment is not possible.
A. 
Every person convicted of violation of any provision of this chapter is guilty of a misdemeanor and shall be punished by imprisonment in the County Jail for a period of not more than 90 days and/or by a fine of not more than $300 and/or by impoundment of the horse operated during such violation.
B. 
In the event of impoundment of any horse, the owner of said horse must pay the cost of transportation and storage and prove ownership of the horse before it will be released to him.
